HomeMy WebLinkAbout017-97RESOLUTION NO. 17-97 DESIGNATING THE DISTRICT ENGINEER AND DIRECTING PREPARATION OF THE ANNUAL REPORT FOR THE DANVILLE STREET LIGHTING AND lANDSCAPE ASSESSMENT DISTRICT 1983-1, AND APPROVING A CONTRACT EXTENSION WITH THE DISTRICT ENGINEER WHEREAS, by its Resolution No. 72-83, the Town Council ordered the formation of, and levied the first assessment within the Danville Street Lighting and Landscaping Assessment District 1983-1, (the District) pursuant to the provisions of the Landscaping and Lighting Act of 1972 (commencing at Section 22500 of the California Streets and Highways Code) hereafter referred to as 'The Act'; and WHEREAS, the District must begin preparing the District Engineer's report and establishing the assessment rates for fiscal year 1997-98. Designating an engineer and ordering preparation of the annual report are the first steps in this process; and WHEREAS, the District has contracted with Berryman and Heniger to prepare the District Engineer's reports and establish the assessment rates for the past three years; now, therefore, be it RESOLVED, that the Danville Town Council does hereby designate Berryman and Henigar as District Engineer for purposes of preparing and filing with the City Clerk a written report in accordance with Section 22565 et. seq. of the Act. The District Engineer is directed to apportion the District assessments in accordance to the benefits received from improvements by the lots, pieces and parcels of land within the District; and be it further RESOLVED, that the Danville Town Council approve a one year extension of the professional services agreement between the Town of Danville and Berryman and Heniger for the preparation of the District Engineer's report and establishment the assessment rates for fiscal year 1997-98.
