HomeMy WebLinkAbout143-96RESOLUTION NO. 143-96 AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY INVOLVING A 5.9+ ACRE PARCEL LOCATED IN THE TASSAJARA LANE/SHERBURNE HILLS ROAD SPECIAL CONCERN AREA (2576 CAMINO TASSAJARA - MIXON PROPERTY) WHEREAS, Mr. Marshall J. Torre, representing Braddock & Logan Services, LLC,requested Town authorization of a General Plan Amendment Study (GPA Study) involving a 5.9+ acre property located along the south side of Camino Tassajara approximately 400 feet east of the northeast corner of the intersection of Sherburne Hills Road; and WHEREAS, the requested GPA Study will consider the merits of a land use designation change from a Residential - Single Family - Low Density (1-3 du/ac) designation to a Residential - Multiple Family - Low Density (7 - 12 du/ac) designation; and WHEREAS, the Town of Danville requires Town Council authorization prior to preparation of GPA Studies; and WHEREAS, the Town Council did consider the project proponent's request at a hearing on October 15, 1996; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Danville Town Council hereby: o Authorizes the initiation of a General Plan Amendment Study (GPA Study) to consider the merits of a land use designation change from a Residential - Single Family - Low Density (1-3 du/ac) designation to a Residential - Multiple Family - Low Density (7 - 12 du/ac) designation for a 5.9_+ acre parcel and also involving a review of the development criteria pertinent to the subject property, as established by the Tassajara Lane/Sherburne Hills Road Special Concern Area. . Directs the project proponents to concurrently submit a Preliminary Development Plan - Rezoning application to reflect the anticipated site development. At the project proponent's discretion, applications for Final Development Plan and Tentative Map may also be submitted. . Directs the project proponents to submit all required information to complete the required environmental review of this proposal. Information submitted to include: a preliminary soil and geotechnical report; a traffic study; a hydraulic study; a tree survey of protected on-site trees; and any additional information deemed necessary by Town staff upon completion of preliminary environmental analysis of the proposal. . Directs the project proponents to submit alternate conceptual land use plans for the intervening land use designations (i.e., plans reflecting a 3 - 5 du/ac density and a 4 - 7 du/ac density); and, be it further RESOLVED, that the Town Council directs that the subject GPA Study be done concurrent and parallel with the comprehensive general plan update to the Danville 2005 General Plan; and, be it further RESOLVED, that the Town Council directs staff to provide mailed notice of all subsequent public hearings on this matter to all surrounding homeowner associations and encourages the project proponents to meet with the surrounding homeowner associations and attempt to accommodate their concerns as regards the land plan that is submitted for review; and be it further RESOLVED, that in authorizing the above mentioned GPA Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
