AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AFFORDABLE HOUSING
AGREEMENT FOR THE MODERATE INCOME HOUSING UNITS REQUIRED TO BE
ESTABLISHED IN PUD 95-03 AND SD 7960 - (CREEK VIEW - MARDEL LLC)
WHERFA. S, on May 7, 1996 the Danville Town Council adopted Resolution No. 62-96
approving Final Development Plan request PUD 95-03 and Tentative Map request SD 7960
(Creek View - Mardel LLC); and
WHEREAS, the action provides for construction of 19 single family residential units on
a 12.4_+ acre parcel located within the Sherburne Hills/Tassajara Lane Special Concern
Area; and
WHEREAS, project conditions linked the approval to the provision of at least two units
(10%___ of the units in the project) at a sale price affordable to moderate income
households earning a maximum of 110% of the published area median household
income, as established by the Department of Housing and Urban Development (HUD);
and
WHEREAS, the developer is required to execute an Affordable Housing Agreement
("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the
affordable housing units; and
WHEREAS, promoting the development of affordable housing within the Town of Danville
is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and
WHEREAS, the Town Council reviewed the Agreement submitted by the developer
regarding regulations pertaining to the occupancy, sale and resale restrictions of the
affordable housing units in the subject development on October 1, 1996; and
WHEREAS, a staff report was submitted recommending that the Town Council approve
the Agreement for the affordable housing units; now therefore be it
RESOLVED, that the Danville Town Council hereby finds that the Agreement regulating
the occupancy, sale and resale for the affordable housing units within PUD 95-03 and SD
7960 is appropriate; and be it further
RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to
execute the Affordable Housing Agreement in the form as lodged with the City Clerk,
together with such changes as may hereafter become necessary, provided such changes
do not materially increase the obligations of the Town thereunder.
