HomeMy WebLinkAbout125-96RESOLUTION NO. 125-96 AUTHORIZING THE MAYOR OF THE TOWN OF DANVILLE TO EXECUTE THE JOINT EXERCISE OF POWERS AGREEMENT BETWEEN CONTRA COSTA COUNTY, THE CITY OF SAN RAMON, AND THE TOWN OF DANVILLE PERTAINING TO SOUTHERN CONTRA COSTA FEES FOR TRAFFIC MITIGATION WHEREAS, the Town of Danville has entered into a Settlement Agreement between Contra Costa County, the City of San Ramon and the Town which outlines certain principles to govern development in the Dougherty Valley and a process and certain actions by which those principles will be implemented; and WHEREAS, the Measure C-1988 Growth Management Program requires that local jurisdictions implement a regional traffic mitigation program to fund regional transportation projects as identified in the Tri-Valley Transportation Plan; and WHEREAS, the Joint Exercise of Powers Agreement pertaining to Southern Contra Costa Fees for Traffic Mitigation ("SCC JEPA") has been developed to (a) finance the roadway improvements called for in the Settlement Agreement and (b) collect regional impact fees for regional improvements on Interstate 680 in Contra Costa County; and WHEREAS, participation in the SCC JEPA is consistent with the terms of the Settlement Agreement, the Measure C-1988 Growth Management Program, and applicable State law pertaining to the collection of development impact fees; now, therefore, be it RESOLVED that the Danville Town Council: (1) determines that the SCC JEPA is not subject to the California Environmental Quality Act pursuant to Article 5, Section 15061(b)(3) CEQA guidelines; (2) directs the Development Services Director to file the Notice of Exemption with the County Clerk; (3) incorporates in this resolution by reference the boundaries, costs, and method of fee apportionment set forth in Ordinance No. 96-09; (4) directs the Finance Director to establish the SCC Sub-Regional Trust Fund and the SCC Regional Trust Fund, and that these trust funds shall now be specific for the SCC Fee Areas, and that the Finance Director shall continue the investment of said monies with interest to accrue in the trust fund accounts; (5) directs the Development Services Director to review the fee schedule periodically, and to adjust for the effects of inflation as describe in Ordinance No. 96-09; (6) directs the Development Services Director to comply with CEQA on development applications and improvement projects to be constructed pursuant to the SCC JEPA; (7) authorizes the Mayor to sign the SCC JEPA, indicating approval by the Town of Danville.
