HomeMy WebLinkAbout116-96RESOLUTION NO. 116-96 DECLARING A SIGN AT 334 HARTZ AVENUE A PUBLIC NUISANCE AND ORDERING ITS ABATEMENT WHEREAS, Chapter 32 of the Danville Municipal Code regulates signs in the Town of Danville; and WHEREAS, Section 32-98.6 requires that a sign permit be secured prior to placing a sign in the Town of Danville; and WHEREAS, Section 32-98.14 requires that permanent signs have a minimum thickness of one-and-one-half inches; and WHEREAS, Mr. Pat Maguire, proprietor of a retail business facility at 334 Hartz Avenue (dba "Danville Gallery"), is displaying a sign that is in violation of the above cited provisions of the Town's sign ordinance; and WHEREAS, Town staff has pursued compliance with the ordinance through contacts with the business proprietor and the property owner (Mr. James Close); and WHEREAS, Section 1-5.5 of the Danville Municipal Code establishes that any condition caused or permitted to exist in violation of the Code, whether the violation is an infraction or a misdemeanor, is a public nuisance and may be summarily abated as such; and WHEREAS, Chapter 1-6 of the Danville Municipal Code establishes an abatement of a nuisance shall commence upon Town Council declaration of a nuisance; and WHEREAS; the Town Council did consider this matter at a noticed public hearing on September 3, 1996; and WHEREAS, the public notice of this action was given in all respects as required by law; now, therefore, be it RESOLVED, that the Danville Town Council declares the display of nonconforming signs without permit at 334 Hartz Avenue (retail business facility dba "Danville Gallery") a public nuisance and orders its abatement within 90 days.
