DECLARING A PUBLIC NUISANCE AT 1271 CAMINO TASSAJARA
AND ORDERING ITS ABATEMENT
WHERFAS, the property at 1271 Camino Tassajara was damaged by fire August 3, 1995;
and
WHEREAS, the damaged structure at 1271 Camino Tassajara has not been repaired or
removed; and
WHEREAS, California Penal Code, Section 370, defines a public nuisance as anything
injurious to health, indecent, offensive to the senses, or that which interferes with the
comfortable enjoyment of life or property by a community, neighborhood or considerable
number of persons; and
WHEREAS, the condition of the property has depreciated property values in the
neighborhood by making home sales and prices decrease, harboring rodents, and
attracting undesirable activity; and
WHEREAS, Mr. and Mrs. English, property owners of 1271 Camino Tassajara, have failed
to repair or demolish the damaged structure in violation of the provisions of the
ordinance as stated above and the Town has pursued compliance with the ordinance
through contacts with the property owners; and
WHEREAS, Chapter 1-6 of the Danville Municipal Code establishes an abatement of a
nuisance shall commence upon Town Council declaration of a nuisance; and
WHEREAS, the Town Council did consider this matter at a noticed public hearing on July
2, 1996; and
WHEREAS, the public notice of this action was given in all respects as required by law;
now, therefore, be it
RESOLVED that the Danville Town Council declares the condition of the property at 1271
Camino Tassajara a public nuisance and orders its abatement.
APPROVED by the Danville Town Council at a Regular Meeting on July 2, 1996 by the
following vote:
