HomeMy WebLinkAbout072-96RESOLUTION NO. 72-96 DECLARING INTENT TO ORDER THE LEVY AND COLLECTION OF ASSESSMENTS AND PROVIDING FOR NOTICE OF HEARING THEREOF FOR DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 WHEREAS, on March 19, 1996, the Town Council adopted Resolution No. 33-96, a Resolution directing the Preparation of the Annual Report for the Danville Street Lighting and Landscape Assessment District 1983-1 (the "District"); and WHEREAS, pursuant to that resolution, a report has been prepared in accordance with Article 4 (beginning with Section 22565 of the California Streets and Highways Code) of Chapter 1 of the Landscaping and Lighting Act of 1972, filed with the City Clerk, and duly considered by this Council; and WHEREAS, it is the intention of this Town Council to levy and collect assessments within the Danville Street Lighting and Landscape Assessment District 1983-1 for the fiscal year 1996- 97. Within said District, the existing and proposed improvements are generally as described on Exhibit 1 attached hereto and hereby made a part thereof; and WHEREAS, the Danville Street Lighting and Landscape Assessment District includes all parcels of land within the incorporated limits of the Town of Danville; and WHERF~S, reference is hereby made to the aforementioned Engineer's Report, on file with the City Clerk, for a full and detailed description of the improvements, the boundaries of the proposed maintenance assessment district and the proposed assessments upon assessable lots and parcels of land within said district; and WHEREAS, the current levies for equivalent dwelling units for benefit zones A, B, C and D are $31.39, $169.28, $42.68 and $40.61 respectively; and WHEREAS, the proposed fiscal year 1996-97 levies for equivalent dwelling units for benefit zones A and D will increase to $34.53 and $54.00 respectively while levies for benefit zones B & C will remain unchanged; and WHEREAS, there are no proposed new improvements, or any substantial changes in existing improvements; now, therefore be it RESOLVED, by the Town Council that on Tuesday, July 16, 1996, at 7:30 p.m., in the regular meeting place of the Town Council, 201 Front Street, Danville, California, a meeting by the Town Council will be held to allow public testimony regarding the proposed increased assessments; and, be it further RESOLVED, that on Tuesday, August 6, 1996, at the hour of 7:30 p.m., in the regular meeting place of the Town Council, 201 Front Street, Danville, California, a public hearing by the Town Council will be held on the question of the levy of the proposed assessments; and, be it further RESOLVED, the City Clerk is directed to give notice of the public meeting and public hearing pursuant to Section 54954.6 (C) (3) of the Government Code; and, be it further RESOLVED, prior to the conclusion of said hearing, any interested person may file a written protest with said clerk, or, having previously filed a protest, may file a written withdrawal of that protest. A written protest shall state all grounds of objection. A protest by a property owner shall contain a description sufficient to identify that property owned by such owner; and, be it further RESOLVED, by the Town Council of the Town of Danville that the report prepared and filed by the Engineer on May 28, 1996 contains all the elements required for such reports by the Landscaping and Lighting Act of 1972, including: 1) an estimate of the annual cost of the improvements; 2) a diagram for the Assessment District; 3) and an assessment of the estimated annual costs of improvements, and is hereby deemed sufficient and preliminarily approved. Said report shall stand as the Engineer's Report for all subsequent proceedings under and pursuant to the foregoing resolution. APPROVED by the Danville Town Council at a regular meeting on June 4, 1996 by the following vote: AYES: Greenberg, NOES: None ABSTAINED: None ABSENT: None Shimansky, Arnerich, Doyle, Waldo MAYOR APPROVED AS TO FORM: CITY ATTORNEY ATTEST: CITY CLERK PAGE 2 OF RESOLUTION NO. 72-96 2 DESCRIPTION OF IMPROVEMENTS TOWN OF DANVILLE DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1 The improvements which can be operated, maintained and serviced by the District consist of landscaping, street lighting, public park facilities and appurtenant facilities including, but not limited to personnel, electrical energy, utilities such as water, materials, contractual services, and other items necessary for the facilities described below. (1) Landscaping The landscaping improvements which will be operated, maintained and services by the District consists of the following streetscapes and feature areas listed below: Streetcsapes Diablo Road Danville Boulevard San Ramon Valley Boulevard Camino Tassajara Sycamore Valley Road E1 Cerro boulevard Camino Ramon Greenbrook Drive El Capitan Drive Old Orchard Road The Historic Downtown Feature Areas Creek Edge Treatment Freeway Interchanges Entries Intersections Medians EXHIBIT 1 All landscape treatment is in conformance with the "Town of Danville Streetscape Beautification Guidelines", dated April, 1986. Landscaping improvements include, but are not limited to: landscaping, irrigation, hardscapes, trees, special paving, landscape walls, furnishings such as pots, bollards, tree grates and appurtenant facilities as required to provide aesthetically pleasing environment throughout the District. (2) Street Lighting: The street lighting system which will be operated, maintained and services by the District consists of the lighted areas located in the former portions of Contra Costa County Service areas L-42, M-6, M-21 and M-22 to the extent they fall within the incorporated limits of the Town of Danville. Recently subdivided lands and other parcels located within the limits of the Town of Danville which have street lighting facilities are also included. Street lights and appurtenant facilities including, but are not limited to poles, fixtures, bulbs, conduits, equipment including guys, anchors, posts, pedestals, and meeting devices as required to provide safe lighting within the boundaries of the District. (5) Public Park Facilities: The public park facilities which are located within the incorporated limits of the Town of Danville will be operated, maintained and services by the District. Public park facilities include, but are not limited to: landscaping, irrigation systems, recreation facilities, hardscapes, sidewalks, trails, fixtures and appurtenant facilities including, but are not limited to lights, playground equipment, play courts, public restrooms, sports fields, parkways, buildings, and designated easements within the boundaries of these parks.
