HomeMy WebLinkAbout166-95RESOLUTION NO. 166-95 AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY TO CONSIDER AMENDING THE CIRCULATION ELEMENT OF THE OLD BLACKHAWK ROAD SPECIFIC PLAN TO ELIMINATE THE SECONDARY ACCESS INTO THE PLAN AREA FROM BLACKHAWK ROAD WHEREAS, Steve Condie, representing the Belleterre Owners' Association, has requested Town authorization of a General Plan Amendment (GPA) Study to allow a review of the merits of developing a collector road envisioned in the Old Blackhawk Road Specific Plan that would connect Old Blackhawk Road to Blackhawk Road; and WHEREAS, the Old Blackhawk Road Specific Plan envisioned that the subject east-west roadway would supply secondary access to the Specific Plan Area (primary access coming from Old Blackhawk Road from Camino Tassajara), with said roadway connection serving to divide Sub-areas 2 (1-3 dus/ac) and 3 (4-7 dus/ac) and providing access to shopping and office development located around the intersection of Crow Canyon Road and Camino Tassajara; and WHEREAS, The Town of Danville requires Town Council authorization prior to preparation of GPA Studies; and WHEREAS, the Town Council did consider the project proponent's request at a hearing on November 8, 1995; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Town Council of the Town of Danville concurs with the recommendations of staff and authorizes the preparation of a GPA Study; and, be it FURTHER RESOLVED, that the Town Council directs staff, when the matter is returned to the Council for consideration and action, to develop a recommended cost recovery plan with allocation of responsibility of payment of the pertinent general plan amendment study fee (i.e., $3,165) to benefiting propoerties within the Study Area (i.e., properties adjoining, or in close proximity to, the subject roadway); and, be it FURTHER RESOLVED, that in authorizing the above mentioned GPA Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
