AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY
INVOLVING A 3.2 +/- ACRE SITE AT THE NORTHWEST CORNER OF THE
INTERSECTION OF EL CERRO BOULEVARD AND EL PINTADO (425 EL PINTADO)
WHEREAS, Edward J. Chilbert (applicant) and Mario Murillo Ministries (property owner
and co-applicant) have submitted a request for authorization of a General Plan
Amendment Study (GPA) for 425 E1 Pintado, a 3.2+ acre property fronting at the
northwest corner of the intersection of El Pintado and E1 Cerro Boulevard (further
identified as Assessors Parcel Number 200-040-012); and
WHERF~S, the subject is identified in the Danville 2005 General Plan for Residential -
Country Estates development and has been previously developed through the land use
permit process with a 7,500_+ square foot medical building (the '~Vard Chiropractic
Center" building); and
WHEREAS, the property owner has requested that the Town of Danville consider a
general plan amendment to accommodate a general office occupancy of the existing
building; and
WHEREAS, The Town of Danville requires Town Council authorization prior to
preparation of GPA Studies; and
WHEREAS, the Town Council considered the project proponent's request at a hearing on
October 3, 1995; and
WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Town Council of the Town of Danville concurs with the
recommendations of staff, as indicated in amended summary form below, and authorizes
the preparation of a GPA Study.

Authorize the initiation of a General Plan Amendment Study to consider the
merits of a land use designation change from a Residential - Country Estates
designation to a Commercial - General Office designation;

Direct the project proponents to concurrently submit a Minor Development
Plan application be required to be submitted concurrent with the GPA
Study. This plan should detail the manner by which on-site parking could
be increased to meet the numerical parking requirements for general office
use (i.e., show how on-site parking could be increased from 25 spaces to
33 spaces to supply a one parking space per 225 grosa aquarc fcct parking

33 spaces to supply a one parking space per 225 gross square feet parking
ratio);

Direct the project proponent for the GPA Study to submit all required
information to complete the required environmental review of this proposal;
and, be it further
RESOLVED that, in authorizing the above mentioned GPA Study, the Town Council is not
indicating any predisposition to approve the requested General Plan Amendment.
