HomeMy WebLinkAbout138-95 RESOLUTION NO. 138-95 REJECTING ALL BIDS AND CALLING FOR NEW BIDS FOR THE CAMINO RAMON SOUNDWALL PROJECT CONTRACT NO - CO45 WHEREAS, the Town Council of the Town of Danville did approve the Call for Bids for the Camino Ramon Soundwall project during the Town Council Meeting of September 5, 1995; and WHEREAS, sufficient funds have been appropriated in the Town of Danville 1994/95 to 2000/01 Capital Improvement Program; and WHEREAS, the Town did receive two bids for the project contract; and WHEREAS, the acting City Clerk of the Town of Danville did, in open session, on the 22 day of September, 1995, publicly opened and read aloud the sealed bids received as required by law; and WHEREAS, the low bidder was Ross F. Carroll, Inc. of Modesto, CA; and WHEREAS, the low bid, by Ross F. Carroll, Inc., has been found to be in violation of Town bid standards which require the primary contractor to complete at least 50 percent of the contract work; and WHEREAS, the second low bid, by Serrano & Cone. Inc., is substantially higher than the Engineer's Estimate and the budget for the construction phase of the project; and WHEREAS, based on the above described concerns, an Administrative Staff Report was submitted recommending the Town Council reject all bids for this project and to authorize a new call for bids for the project; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville, that all bids are rejected; and, be it further RESOLVED, by the Town Council of the Town of Danville that the City Engineer is hereby authorized and directed to initiate a new call for bids for the Camino Ramon Soundwall project APPROVED by the Danville Town Council at a Regular Meeting held on Tuesday, October 3, 1995, by the following vote: AYES: Greenberg, Doyle, NOES: None ABSTAINED: None ABSENT: None Ritchey, Shimansky, Waldo MAYOR APPROVED AS TO FORM: CITY ATTORNEY adcz44 ATTEST: ACTING CITY CLERK
