HomeMy WebLinkAbout108-95RESOLUTION NO. 108-95 ATTACHMENT A APPROVING A MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE AND APPROVING USE GUIDELINES FOR PHASE I OF HAP MAGEE RANCH PARK WHEREAS, The Town of Danville in conjunction with the Alamo/Danville Joint Planning and Operations Committee has requested approval of Use Guidelines to allow for the scheduling of activities and programs for the previously developed Phase 1 portion of Hap Magee Ranch Park, an approximately 6 acre portion of the total approved 17 +/- acre park; and WHEREAS, the subject site is located on the northwest side of La Gonda Way, at the Town's northerly Town limits, and is identified as Assessor's Parcel Number's 197-240- 004 & 197-240-003; and WHEREAS, on November 9, 1989, the Town Council of the Town of Danville approved Resolution No. 194-89 adopting the Final Master Development Plan for Hap Magee Ranch Park and granting a Mitigated Negative Declaration of Environmental Significance for the project; and WHEREAS, the previously approved Hap Magee Ranch Final Master Plan was designed to provide for a multi-use site that can accommodate classes, community activities, historical displays, casual family picnics and large formal gatherings; and WHEREAS, the previously approved Mitigated Negative Declaration of Environmental Significance established for the Hap Magee Ranch Park project identified and adopted mitigation measures which reduced potential environmental impacts to a less than significant level for the entire Hap Magee Ranch Park project; and WHEREAS, the Town of Danville in conjunction with the Alamo/Danville Joint Planning and Operations Committee wish to allow for the establishment of uses for the Phase I portion of the park only, consistent with the range of uses previously approved for the entire park; and WHEREAS, an Initial Study of Environmental Significance has been prepared to identify potential environmental impacts associate with the establishment of uses for the Phase I portion of the park, a reduction in scope from the previously approved Final Master Plan for the entire Hap Magee Ranch Park development; and WHEREAS, through the Initial Study, several potential environmental impacts associated with the project have been identified; and PAGE 1 OF RESOLUTION NO. 108-95 WHEREAS, mitigation measures, as contained within the draft Mitigated Negative Declaration of Environmental Significance attached as Exhibit 1, have been identified which reduce the potential impacts to a less than significant level; and WHEREAS, the Use Guidelines for the park include off-site road improvements to La Gonda Way to reduce potential hazards associated with additional traffic as well as limitation on the scheduling of activities and programs as specified within the Mitigated Negative Declaration of Environmental Significance; and WHEREAS, the on going maintenance and administration activities related to the operation of the park are not considered scheduled activities and programs regulated by the proposed use guidelines; and WHEREAS, unless otherwise approved, any scheduled use, but not construction of, future Phases of the park will be subject to compliance with the previously adopted mitigation measures identified in conjunction with the Hap Magee Ranch Park Master Plan; and WHEREAS, the project was reviewed by the Danville Parks and Leisure Services Commission on July 12, 1995; and WHEREAS, on July 12, 1995 the Parks and Leisure Services Commission adopted Resolution No. 01-95 recommending the Town Council approve the request; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Town Council approve the request; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Town Council of the Town of Danville adopts a Mitigated Negative Declaration of Environmental Significance and approves of the Hap Magee Ranch Park Phase I Use Guidelines and makes the following findings in support of this action: Use Guidelines . The proposed project is consistent with the Danville 2005 General Plan and the Contra Costa County General Plan. 2. The proposed project is consistent with the development and use of the park as PAGE 2 OF RESOLUTION NO. 108-95 envisioned under the previously approved Hap Magee Ranch Park Final Master Plan. . . . The proposed project use will not be detrimental to the to the health, safety, and general welfare of the Town or the community of Alamo. The proposed project will not adversely affect the orderly development of property within the Town or the community of Alamo. The proposed project will not adversely affect the preservation of property values and the protection of the tax base within the Town or the community of Alamo. . The proposed project will not create a nuisance and/or enforcement problem within the neighborhood or community. Mitigated Negative Declaration . All potentially significant environmental impacts have been mitigated through project modifications. As mitigated through the adoption of use guidelines and off-site roadway improvements identified within the Mitigated Negative Declaration of Environmental Significance, no significant impacts are anticipated to be associated with the project. . There is no evidence that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. The guidelines would allow the scheduling of a variety of activities and programs at Hap Magee Ranch Park. All proposed mitigation measures are interim only, and apply to the scheduling of activities for the currently developed phase 1 of the park. Unless otherwise approved through the public hearing process, development of future phases of the park will be required to comply with all mitigation measures previously established under the Hap Magee Ranch Park Final Master Plan. ENVIRONMENTAL EFFECTS: 13. Transportation/Circulation. Will the proposal result in: a. Generation of substantial additional vehicular movement? Maybe. b. Effects on existing parking facilities, or demand for new parking? Maybe. c. Substantial impact upon existing transportation systems? Maybe. f. Increase in traffic hazards to motor vehicles, bicyclists or pedestrians? Maybe. Explanation: The scheduling of specific activities and programs at the park could lead to additional users of the park. All vehicular traffic must use La Gonda Way, a two lane residential road, to access the park. In addition, the park has a fixed, and limited, on-site parking capacity, with limited off-site (on street) parking available. Additional traffic could lead to additional hazards for motor vehicles, bicyclists and pedestrians. PAGE 1 OF EXHIBIT 1 / , Mitigation Measures Traffic safety for La Gonda Way shall be improved by trimming back bushes and trees that encroach into the public right-of-way on La Gonda Way near the park. This will significantly increase the width of roadway available for motorists and enhance sight distance. . Debris that is covering street pavement on northbound La Gonda Way, just before it turns east approaching the park, shall be removed. . The outer edgeline on the curving section portion of westbound to southbound La Gonda Way, near the front of the park, shall be striped. 4. The travel lanes of the curving westbound to southbound portion of La Gonda Way, near the front of the park, shall be delineated in such a manner so as to discourage southbound motorists from "cutting the COrner". 5. The hours for all scheduled activities and programs shall be limited to the hours between 9:00 a.m. and 4..00 p.m. and after 6)00 p.m. Monday through Friday. All day Saturday and Sunday may be made available for scheduled activities and programs. 14. Public Service. Will the proposal have an effect upon, or result in a need for new or altered governmental services in any of the following areas: d. Parks or other recreational facilities? Maybe. Explanation: The proposal will result in use guidelines which will allow for the scheduling of specific activities and programs at Hap Magee Ranch Park. The regular operation of specific programs and the regular scheduling of activities may increase the level of activity at the park. Mitigation Measures o To coincide with the limited number of on-site parking spaces, the cumulative, simultaneous total of all activities and programs at the park at any given time shall be limited to 25 vehicles or less. 7. Activities and programs shall be scheduled to avoid overlap between one group leaving the park and another group arriving at the park. PAGE 2 OF EXHIBIT 1 19. Recreation. Will the proposal result in an impact upon the quality or quantity of existing recreational opportunities? The proposal will result in use guidelines which will allow for the scheduling of specific activities and programs at Hap Magee Ranch Park. The regular operation of specific programs and the regular scheduling of activities may increase the level of activity at the park. 6. To coincide with the limited number of on-site parking spaces, the cumulative, simultaneous total of all activities and programs at the park at any given time shall be limited to 25 vehicles or less. 7. DETERMINATION: There is no evidence before the Town that the proposed project will have potential for an adverse effect on wildlife resources or the habitat upon which the wildlife depends. A Draft Mitigated Negative Declaration of Environmental Significance has been prepared for this project. Potentially significant environmental impacts have been mitigated through project modifications. As proposed and mitigated, no significant impacts are anticipated to be associated with the project. S, the public notice of this action was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that the Parks and Leisure Services Commission approve the request; and WHEREAS, the Parks and Leisure Services Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Parks and Leisure Services Commission recommends the grant of a Mitigated Negative Declaration of Environmental Significance and approval of the Hap Magee Ranch Park Phase 1 Use .Guidelines and makes the following findings in'support of this action: Use Guidelines , The proposed project is consistent with the Danville 2005 General Plan and the Contra Costa County General Plan.
