APPROVING THE AWARD OF CONTRACT FOR THE
DIABLO ROAD/CREEK SLIDE REPAIR, FEMA DSR NO. 49917
WHEREAS, a slide has occurred on the north side of Diablo Road adjacent to Green Valley Creek
approximately 1,000 feet east of Alameda Diablo; and
WHEREAS, staff applied for and received approval for Federal Emergency Management Agency (FEMA)
and State Office of Emergency Service (OES) funds to repair the slide; and
WHEREAS, the Town Council has previously approved bidding the Diablo Road/Creek Slide Repair
project; and
WHEREAS, the Acting City Clerk of this Town did, in open session on the 20th day of July, 1995,
publicly open and read aloud the sealed bids received as required by law; and
XVHEREAS, the low bidder is Up Grade Construction of San Jose, CA and the City Engineer has
recommended awarding a contract for the project to said firm; now, therefore, be it
RESOLVED, by the Town Council of the Town of Danville that $39,016 be appropriated for the
subject project from the FEMA account; and, be it
FURTHER RESOLVED, by the Town Council of the Town of Danville, that the Town Manager be and
hereby is authorized to execute, on behalf of the Town, a written contract with Up Grade
Construction of San Jose, CA for $88,800 for work in connection with the Diablo Road/Creek Slide
Repair project in the form as lodged with the City Clerk, together with such changes as may hereafter
be necessary, provided such changes do not materially increase the obligations of the Town
thereunder, and to receive and approve all bonds in connection therewith, and the City Clerk is
hereby directed to attest same and affix thereto the official seal of the Town; and, be it
FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this
Resolution, transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. Should a
finding of any discrepancy regarding the ratio of apprentices to journeymen be made, the Town shall
notify the Division of Apprenticeship Standards to such findings.
