HomeMy WebLinkAbout080-95RESOLUTION NO. 80-95 A RESOLUTION PRELIMINARILY APPROVING THE ENGINEER'S REPORT DECLARING INTENT TO ORDER LEVY AND COLLECTION OF ASSESSMENTS AND PROVIDING FOR NOTICE OF HEARING THEREOF DANVILLE STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 RESOLVED, by the Town Council of the Town of Danville, County of Contra Costa, California, that . On May 16, 1995, this Town Council adopted Resolution No. 72-95, a Resolution directing Preparation of Annual Report for the Danville Street Lighting and Landscape Assessment District 1983-1, (the "District"). Pursuant to said resolution, a report, in accordance with Article 4 (beginning with Section 22565 of the California Streets and Highways Code) of Chapter I of the Landscaping and Lighting Act of 1972 has been made, filed with the City Clerk, duly considered by this Council, and is hereby deemed sufficient and preliminarily approved. Said report shall stand as the Engineer's Report for all subsequent proceeding under and pursuant to the foregoing resolution. o It is the intention of this Town Council to levy and collect assessments within the Danville Street Lighting and Landscape Assessment District 1983-1 for the fiscal year 1995-96. Within said District, the existing and proposed improvement and any substantial changes proposed to be made to the existing improvements are generally as described on Attachment B attached hereto and hereby made a part thereof. . The Danville Street Lighting and Landscape Assessment District includes all parcels of land within the incorporated limits of the Town of Danville. , A. Reference is hereby made to the aforementioned Engineer's Report, on file with the City Clerk, for a full and detailed description of the improvements, the boundaries of the proposed maintenance assessment district and the proposed assessments upon assessable lots and parcels of land within said district. B. Notice is hereby given that on Tuesday, the 1st day of August 1995, at the hour of 7:30 o'clock p.m., in the regular meeting place of the Town Council, 201 Front Street, Danville, California, a hearing by the Town Council will be held on the question of the levy of the proposed assessment. C. The City Clerk is directed to give notice of the Public Hearing by having the Resolution published and posted under Section 6061 of the Government Code and Sections 22552 and 22554 of the Streets and Highways Code. Prior to the conclusion of said hearing, any interested person may file a written protest with said clerk, or, having previously filed a protest, may file a written withdrawal of that protest. There are no proposed new improvements, or any substantial changes in existing improvements, and . On Monday May 26, 1995, the Engineer filed his report with Maintenance Services Manager for submission to the Town Council, and the Maintenance Services Manager has submitted the report to the Town Council for consideration. NOW, THEREFORE, BE IT FURTHER RESOLVED by the Town Council of the Town of Danville that the report prepared and filed by the Engineer on May 26, 1995, contains all the elements required for such reports by the Landscaping and Lighting Act of 1972, including: (1) an estimate of the annual cost of the improvements; (2) a diagram for the Assessment District; and an assessment of the estimated annual costs of improvements.
