HomeMy WebLinkAbout077-95RESOLUTION NO. 7%95 APPROVING AN AFFORDABLE HOUSING AGREEMENT BETWEEN BRADDOCK & LOGAN GROUP AND THE TOWN OF DANVILLE REGULATING OCCUPANCY, SALE AND RESALE OF THE AFFORDABLE HOUSING UNITS WITHIN PUD 93-03 AND SD 7850 (BRADDOCK AND LOGAN) WltEREAS, on August 3, 1993 the Danville Town Council adopted Resolution No. 87 -93 approving PUD 93-03 (Braddock 8~ Logan Group); and WHEREAS, the action provides for construction of 18 single family residential units on a two+ acre parcel located on the west side of West E1 Pintado, opposite Ilo Lane (APN # 200-170-. 007); and WHEREAS, conditions of approval for the project require that Braddock & Logan Group construct two units for four person moderate income households earning between 80 % and 120 % of the area median income; and WHEREAS, Braddock & Logan Group is required to execute an Affordable Housing Agreement ("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the affordable housing units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the adopted 1990-1995 Housing Element Update of the Town of Danville; and WHEREAS, the Town Council reviewed the Agreement submitted by Braddock & Logan Group for regulating occupancy, sale and resale restrictions of the affordable housing units in the subject development on June 6, 1995; and WHEREAS, a staff report was submitted recommending that the Town Council approve the Agreement with Braddock & Logan Group for the affordable housing units; and WHEREAS, minor revisions to the Agreement need to be made prior to its execution (i.e., dropping Section 5 which served as a request that Town waive Building Division fees applicable to the affordable units; insert the applicable maximum purchase price per Attachment D of this report; and provide more clarity that purchasers of the units - both for initial sales and subsequent resales - must meet certain income eligibility standards); and WHEREAS, these revisions have been discussed with the developer, who has indicated that they are acceptable and will be incorporated into the executed document.now therefore be it RESOLVED, that the Danville Town Council hereby finds that the Agreement regulating the PAGE NO. i RESOLUTION NO. 77-95 occupancy, sale and resale for the affordable housing units within PUD 93-03 is appropriate; and be it further RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Affordable Housing Agreement with Braddock & Logan Group in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
