HomeMy WebLinkAbout062-95RESOLUTION NO. 62-95 AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY AND DIRECTING THE CONCURRENT SUBMITTAL AND CONSIDERATION OF A PRELIMINARY DEVELOPMENT PLAN - REZONING FOR AN 2.69+/-ACRE SITE IDENTIFIED AS ASSESSORS PARCEL NUMBER 200-151-007 (CORRIE DEVELOPMENT CORPORATION APPLICANT / OWNER) WHEREAS, Sidney Corrie, Jr., on behalf of Corrie Development Corporation, has submitted a request for authorization of a General Plan Amendment (GPA) Study for 500 La Gonda Way, a 2.69+/- acre property fronting at the northeast corner of the intersection of La Gonda Way and E1 Cerro Boulevard (further identified as Assessors Parcel Number 200-151-007); and WHEREAS, the subject is identified in the Danville 2005 General Plan for Commercial - General Office development; and WHERF~S, the property owner has requested that the Town of Danville consider a general plan amendment to accommodate a multiple family residential development with a density of up to 29 dwelling units per acre; and WHERFAS, the current range of residential general plan land use categories in the Danville 2005 General Plan would need to be expanded as part of any GPA Study to provide for a 22 - 29 dwelling unit per acre density range; and WHEREAS, The Town of Danville requires Town Council authorization prior to preparation of GPA Studies; and WHERFakS, the Town Council did consider the project proponent's request at hearings of October 18, 1994 and April 18, 1995; and WHERF~S, at the October 18, 1994 hearing the Town Council indicated its conceptual approval to authorize the Cottie GPA Study and further indicated a desire to; expand the GPA Study to include neighboring La Gonda Way / El Cerro Boulevard properties; to have staff survey neighboring property owners as to their interest in participating in the expanded study; to have staff research methods to fund the expanded GPA Study; and to have staff provide the Council with information on the scope and cost of the expanded GPA Study; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it PAGE NO. 1 OF RESOLUTION NO. 62-95 RESOLVED that the Town Council of the Town of Danville concurs with the recommendations of staff, as indicated in amended summary form below, and authorizes the preparation of an expanded GPA Study. . Authorize the initiation of a General Plan Amendment (GPA) Study to consider the merits of a land use designation change from Commercial - General Office to a Residential - Multiple Family designation (either Low Density 7 - 12 du/ac or Medium Density 13 - 21 du/acre) involving the 2.69+/- acre Cottie property with consideration given to floor-area-ratio development standards as well as dwelling units / acre considerations. . Direct the project proponents for the Corrie GPA Study to concurrenfiy submit preliminary site plans reflective of anticipated site development. At the project proponent's discretion, applications for Preliminary Development Plan - Rezoning application; Final Development Plan; and Tentative Map may also be submitted. . Direct the project proponent for the Corrie GPA Study to submit all required information to complete the required environmental review of this proposal. Information submitted to include: a traffic study and a noise study, as well as any additional information deemed necessary by Town staff upon completion of preliminary environmental analysis of the proposal. . Authorize the initiation of a Town-initiated GPA Study to consider the merits of a land use designation change involving properties in the southeast quadrant of the La Gonda Way / E1 Cerro Boulevard intersection from Commercial - General Office to a Residential - Multiple Family designation (either Low Density 7 - 12 du/acre or Medium Density 13 - 21 du/acre) or to a new Mixed Use designation accommodating development of office and/or multiple family residential uses. . Direct staff to formulate a cost reimbursement strategy for subsequent Council consideration which would be imposed upon any property involved in the Town-initiated GPA Study if that property subsequently pursued an entitlement directly benefitting from the Town-initiated GPA Study. Reimbursement of any up front expenses would be directed to the project proponents of the Corrie GPA Study and/or to the Town of Danville, as appropriate, to offset up front expenses incurred to expand the scope of study of traffic, noise and / or other special studies so as to benefit properties beyond the Cottie property. . Authorize expenditure of Planning Division Consultant funds of up to $10,000 to cover the expenses related to the Town-initiated GPA Study which ave incurred to expand the scope of study of traffic, noise and / or PAGE NO. 2 OF RESOLUTION NO. 62-95 other special studies beyond the scope necessary to address the Corrie GPA Study. and, be it further RESOLVED that, in authorizing the above mentioned GPA Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
