SETTING THE 1995-1996 STORMWATER UTILITY ASSESSMENT (SUA)
AND AUTHORIZING CONTINUED PARTICIPATION IN THE COUNTYWIDE
NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES)
WHERF~S, the Federal Water Pollution Control Act requires dischargers of storm water
to obtain a permit from the appropriate California Regional Water Quality Control
Board under the National Pollutant Discharge Elimination System (NPDES) program;
and
WHEREAS, Danville has joined 17 other cities within Contra Costa County,
Contra Costa County Flood Control and Water Conservation District and Contra Costa
County to secure the required permit effective through May 1, 1998; and
WHEREAS, the funding of said permit has been established through the Stormwater
Utility Assessment (SUA) at $22 per Equivalent Residential Unite (ERU) per Resolution
No. 24-93; and
WHEREAS, said assessment rate must be set each year by Town Council; and
WHEREAS, Town Council wishes to continue participation with the NPDES program
and continue funding the program through assessment of individual properties; now,
therefore, be it
RESOLVED, by the Town Council of the Town of Danville to support and continue to
authorize the Stormwater Utility Assessment for all properties within Danville; and, be
it
FURTHER RESOLVED, that the 1995-1996 Stormwater Utility Assessment shall remain
at $22 per ERU and the maximum permissible rate shall remain at $30 per ERU.
