APPROVING THE AWARD OF CONTRACT FOR CONSTRUCTION OF THE NEW
DANVILLE LIBRARY AND COMMUNITY CENTER - CIP PROJECT NO. B-050 AND
NO. B-243, AUTHORIZING THE TOWN MANAGER TO EXECUTE THE CONTRACT,
AND APPROPRIATING ADDITIONAL FUNDS
WHEREAS, this project is funded by the Civic Facilities Fund, a donation, and by the proceeds from
the Tax Allocation Bonds approved by the Town (Town Council Resolution 143-94 and Community
Development Agency Resolution No. 6-94), and received by the Town of Danville on December 15,
1994; and
WHEREAS, the Town Council adopted Resolution No. 114-94 on September 20, 1994, authorizing
staff to establish a pre-qualification list of contractors for the project; and
WHEREAS, the Town Council adopted Resolution No. 130-94 on October 18, 1994, calling for bids
for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 19th day of December, 1994,
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the low bidder is Overaa of Richmond, and the Town Manager has recommended
awarding a contract for the project to said firm; now, therefore, be it
RESOLVED, by the Town Council of the Town of Danville, that an additional $1,814,321 is hereby
appropriated from the Civic Facilities Fund (including the proceeds of the Tax Allocation Bonds sold
for this project and from a donation); and, be it
FURTHER RESOLVED, that the contract for construction of the new Danville Library and
Community Center, CIP Project B-050 and B-243 be awarded to the low bidder Overaa of Richmond:
and, be it
FURTHER RESOLVED, that the Town Manager be and hereby is authorized to execute, on behalf
of the Town, a written contract with Overaa of Richmond, for $4,576,070 plus a 10% construction
contingency of $457,630, for a total of $5,033,700 for construction of the Danville Library and
Community Center - CIP Projects No. B-050 and B-243 in the form as lodged with the City Clerk,
together with such changes as may hereafter be determined necessary, provided such changes do not
materially increase the obligations of the Town thereunder, and to receive and approve all bonds in
connection therewith, and the City Clerk is hereby directed to attest same and affix thereto the official
seal of the Town; and, be it
FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this
Resolution, transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. (Note:
Should a finding of any discrepancy regarding the ratio of apprentices to journeymen be made, the Town
shall notify the Division of Apprenticeship Standards to such findings.)
