AUTHORIZING DISBURSEMENT OF EXCESS MAP PROCESSING FUNDS
ASSOCIATED WITH DEVELOPMENT ENTITLEMENTS FOR THE
ALAMO SPRINGS DEVELOPMENT PROJECT
WHEREAS, Town Council Resolution No. 98-89 provided for the creation of a
Memorandum of Understanding (M.O.U.) between the Town of Danville and Contra Costa
County which established the mechanics for a joint development review process of the
Alamo Springs residential proposal; and
WHEREAS, the M.O.U. established a budget estimate for the review of the project and
indicated that if costs of project review exceeded the budget estimate that the developer
would contribute the additional funds necessary to allow full review of the development
proposal; and
WHEREAS, during the course of processing planning entitlements addressed by the
M.O.U., additional funds were collected from the developer to cover additional estimated
costs associated with the development review process for project; and
WHERF~S, New West Federal Savings and Loan Association (property owners at the time
the planning entitlements addressed by the M.O.U. were under review) submitted the
necessary funds to cover processing costs associated with the development review process
for project; and
WHEREAS, ownership of the subject property was subsequently transferred to Brazos
Asset Management, Inc. following joint approval of various planning entitlements
considered under the M.O.U. by the Town of Danville and by Contra Costa County; and
WHEREAS, Brazos Asset Management, Inc. was advised that the Town of Danville with
financial management responsibilities as established by the M.O.U., is in possession of
excess map processing funds that had been previously deposited with the Town to cover
processing costs associated with the development review process for the project; and
WHEREAS, Brazos Asset Management, Inc. has requested, by way of a letter dated
November 18, 1994, that the Town of Danville disburse excess map processing funds for
the previous entitlements to Brazos Asset Management, Inc.
WHEREAS, all invoices associated with processing the referenced planning entitlements
have been received and processed; and

WHEREAS, materials submitted to the Town of Danville (i.e., copy of grant deed
pertaining to the subject property) adequately document that Brazos Asset Management,
Inc. is the current owner of the subject property and therefore has rights to the refund
of excess map processing funds; now, therefore, be it
RESOLVED, that the Town Council of the Town of Danville hereby authorizes the
disbursement of $11,059.00 of excess map processing funds for the Alamo Springs
residential proposal to Brazos Asset Management, Inc. (Account No.006-004.006).
APPROVED by the Danville Town Council at a special meeting on December 14, 1994,
by the following vote:
