HomeMy WebLinkAbout141-94~When~recorded, return to: ~ /-~ Town o~f Danville-Mike Zuspan 510 LaGonda Wy RESOLUTION NO. 141-94 Dgnville, CA 94526 TERMINATING ~,)FFFRS OF DEDICATION OF STREET RIGHT-OF-WAYS AND ABANDOl~ING THE RIGHT TO ACCEPT SAID OFFERS WHERF_AS, Barbara Jear Ageno has petitioned the Town of Danville to terminate street right-of-way dedicauons: and WHEREAS, the street right-of-way dedications are those offered to the County (the Town by incorporation) and described on attached "Exhibit A" and Exhibit "B"; and WHEREAS, said Offers of Dedication lie within the Town limits of the Town of Danville; and WHEREAS, said Offers of Dedication lie in areas unused for the purposes for which dedicated for at least fWe consecutive years proceeding this action; and WHEREAS, terminatic:n of these Offers of Dedication are minor in nature and are therefore exempt fron-: General Plan Conformance determination per Resolution No. 103-86; and WHEREAS, terminati'on ,of offers of dedication and the right to accept such offers may be abandoned pursuant to the Streets and Highways Code, Division 9, Part 3; now, therefore, be it RESOLVED, by the Tort n Council of the Town of Danville that the street right-of-way dedications offered ~5:o the Town, described above, have been 'unused for the purposes for which dedicated for at least five proceeding consecutive years and that this action is made pursuant to, the Streets and Highways Code, Division 9, Part 3, Chapter 4, § 8331(a); and, be it FURTHER RESOLVED, that these Offers of Dedication are hereby terminationed and the right of the Town of Danville to accept said Offers of Dedication are hereby abandoned and the Tcwn staff is hereby authorized and directed to execute and record this Resolution on behalf of the Town. C. COUNTY", "PROPOSED 26' R/W TO BE DEDICATED TO C. C. COUNTY", "PROPOSED 52' R/W TO BE DEDICATED TO C. C. COUNTY" AND "PROPOSED 27' R/W TO BE DEDICATED TO C. C. COUNTY" on Parcel Map MS 158- 67 recorded in Parcel Map Book 5, page 22, and as identified on the Offers of Dedication recorded in Book 5706 of Official Records, pages 178 through 180, both on file in the Office of the Recorder of Contra Costa County. t~ -d Note: The areas identified by the following documents in Official Books, overlap the areas described above.
