APPROVING THE AWARD OF CONTRACT FOR THE
OVERHEAD TO UNDERGROUND ELECTRICAL SERVICE CONVERSION -
EAST PROSPECT AVENUE AND SOUTH FRONT STREET
WHEREAS, this project is funded by the General Fund; and
WHEREAS, the Town Council has previously approved bidding the Overhead to Underground
Electrical Service Conversion - East Prospect Avenue and South Front Street; and
WHEREAS, the City Clerk of this Town did, in open session on the 20th day of October, 1994,
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the bid of the apparent low bidder, M.D. Busco Electric of Antioch, has been
determined to be non-responsive, and the City Engineer has recommended rejecting said bid; and
WHEREAS, the second low bidder, Morgan Electric and Lighting of Danville, has submitted a
responsive bid and the City Engineer has recommended awarding the project to said firm; now,
therefore, be it
RESOLVED, by the Town Council for the Town of Danville, that the bid of M.D. Busco
Electric Company of Antioch is non-responsive and on the recommendation of the City Engineer,
is rejected, and that the Town Manager be and hereby is authorized to execute, on behalf of the
Town, a written contract with Morgan Electric and Lighting of Danville, for $22,270.00 plus a 15%
construction contingency of $3,341.00, for a total of $25,611.00 for work in connection with the
Overhead to Underground Electrical Service Conversion - East Prospect Avenue and South
Front Street in the form as lodged with the City Clerk, together with such changes as may
hereafter be determined necessary, provided such changes do not materially increase the
obligations of the Town thereunder, and to receive and approve all bonds in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal
of the Town; and, be it
FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this
Resolution, transmit an Extract of Public Works contract award to the Department of
Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101.
(Note: Should a finding of any discrepancy regarding the ratio of apprentices to journeymen be
made, the Town shall notify the Division of Apprenticeship Standards to such findings.)
