APPROVING THE AWARD OF CONTRACT FOR THE
PAVEMENT OVERLAY PROJECT - 1994
WHE~S, this project is funded by Gas Tax Funds; and
~VI-IE~S, the Town Council has previously approved bidding the Pavement Overlay
Project- 1994; and
WHEREAS, the City Clerk of this Town did, in open session on the 29th day of August, 1994,
publicly open and read aloud the sealed bids received as required by law; and
WHE~S, the low bidder is O'Grady Paving, Inc., and the City Engineer has recommended
awarding a contract for the project to said firm; now, therefore, be it
RESOLVED, by the Town Council for the Town of Danville, that the Town Manager be and
hereby is authorized to execute, on behalf of the Town, a written contract with
O'Grady Paving, Inc., for $243,917.90 plus 15% construction contingency of $36,587.00, for
a total of $280,504.90 for work in connection with the Pavement Overlay Project - 1994 in
the form as lodged with the City Clerk, together with such changes as may hereafter be
determined necessary, provided such changes do not materially increase the obligations of
the Town thereunder, and to receive and approve all bonds in connection therewith, and the
City Clerk is hereby directed to attest same and affix thereto the official seal of the Town;
and, be it
FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this
Resolution, transmit an Extract of Public Works contract award to the Department of
Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco,
CA 94101. (Note: Should a finding of any discrepancy regarding the ratio of apprentices
to journeymen be made, the Town shall notify the Division of Apprenticeship Standards to
such findings.)
APPROVED by the Danville Town Council at a Regular Meeting on September 6, 1994 by
the following vote:
