OPPOSING ASSEMBLY BILL 3142, REQUIRING THAT RAILROAD RIGHTS-OF-WAY
PURCHASED WITH STATE FUNDS ONLY BE USED FOR RAIL PURPOSES
WHEREAS, AB 3142 amends existing law governing the use of Transportation Planning and
Development funds; and
WHEREAS, the specific amendments could affect funds utilized to purchase the Iron Horse
Trail within the Town of Danville; and
WHERF~S, AB 3142 could require that rights of way purchased with these funds be utilized
only for rail passenger, rail transit or rail freight purposes; and
WHEREAS, if rights of way purchased with these funds are not used for rail purposes, the
public agency shall reimburse the State for the appraised value of that portion of the right-of-
way used for non-rail purposes; and
WHEREAS, the Iron Horse Trail offers an alternative to single occupant vehicles for bicycle
and pedestrian commuters, fulfilling numerous State, regional and local goals for
transportation now and in the future; and
WHEREAS, AB 3142 could penalize Contra Costa County for successful utilization of an
abandoned railroad right-of-way; now, therefore be it
RESOLVED, that the Town Council of the Town of Danville hereby opposes AB 3142 as it is
currently written and authorizes the Town Manager to send letters of opposition to the
Governor.

Tuesday, September 6, 1994 by the following vote:
