HomeMy WebLinkAbout085-94RESOLUTION NO. 85-94 APPROVING A MODERATE INCOME HOUSING AGREEMENT BETWEEN KAUFMAN AND BROAD OF NORTHERN CALIFORNIA AND THE TOWN OF DANVILLE REGULATING OCCUPANCY, SALE AND RESALE OF THE MODERATE INCOME UNITS WITHIN PUD 93-04, PUD 94-01 AND SD 7889 (KAUFMAN AND BROAD). WHEREAS, on December 7, 1993 the Danville Town Council adopted Resolution No. 167-93 approving PUD 93-04 (Kaufman and Broad); and WHEREAS, on April 5, 1994, the Danville Town Council adopted Resolution No. 45-94 approving PUD 94-01 (Kaufman and Broad); and WHEREAS, the actions jointly provide for construction of 196 units on a 11.1 +/- acre parcel located on the south side of Center Way, east of Crow Canyon Road (APN # 206-010-012); and WHEREAS, conditions of approval for the project require that Kaufman and Broad construct twenty units for four person moderate income households earning between 80% and 120% of the area median income and ten units for four person households earning between 120% and 140% of the area median income; and WHEREAS, Kaufman and Broad is required to execute a Moderate Income Housing Agreement ("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the "moderate" income units; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the Housing Element of the Town of Danville; and WHEREAS, the Town Council reviewed the Agreement submitted by Kaufman and Broad for regulating occupancy, sale and resale restrictions of the "moderate" income units in the subject development on July 19, 1994; and WHEREAS, a staff report was submitted recommending that the Town Council approve the Agreement with Kaufman and Broad for the "moderate" income units; now therefore be it RESOLVED, that the Danville Town Council hereby finds that the Agreement regulating the occupancy, sale and resale for the "moderate" income units within PUD 93-04 and PUD 94-01 is appropriate; and be it further PAGE I RESOLUTION NO. 85-94 RESOLVED, that the Danville Town Council hereby authorizes the Town Manager to execute the Moderate Income Housing Agreement with Kaufman and Broad in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
