HomeMy WebLinkAbout070-94RESOLUTION NO. 70-94 REQUESTING CENTRAL CONTRA COSTA SANITARY DISTRICT TO RECUPERATE THE AB939 PLANNING FEE REVENUE TO THE TOWN OF DANVILLE BETWEEN THE TIME OF DISCONTINUATION BY CONTRA COSTA COUNTY AND DECEMBER 31, 1994, AND REQUESTING THE CENTRAL CONTRA COSTA SANITARY DISTRICT TO IMPOSE SOLID WASTE FEES SUFFICIENT TO COLLECT THE EXISTING AB939 FEE RATE OF 80¢ PER TON ON A CONTINUAL BASIS WHEREAS, as part of the cost mitigation for city staffs in Contra Costa County to respond to the requirements of state-mandated AB 939, a fee of 80¢ per ton of solid waste levied at Acme has been received by each city through Contra Costa County as a portion of the "tipping fee"; and WHEREAS, there currently exists a situation whereby some cities in Contra Costa County are receiving AB 939 tipping fee revenues despite not utilizing the Keller Canyon Landfill as anticipated; and WHEREAS, the Public Managers' Association (PMA) Solid Waste Subcommittee has recommended that cities in East and Central Contra Costa County discontinue levying the 80¢ per ton tipping fee through Contra Costa County in order to rectify the incongruence between cities utilizing Keller Canyon and cities receiving tipping fee revenue; and WHEREAS, the Town of Danville concurs with the recommendations of the PMA Solid Waste Subcommittee, approving Resolution No. 69-94 to discontinue collection by Contra Costa County; and WHEREAS, because the Central Contra Costa Sanitary District (CCCSD) franchises for solid waste services in the Town of Danville, the Town must request of CCCSD that they reimburse the AB939 fees which would have been collected by the County through the end of the current calendar year, and further, that CCCSD continue to impose solid waste fees sufficient to match the existing AB939 fee of 80¢ per ton on a continual basis and thereby provide payment quarterly to the Town of Danville; now, therefore, be it RESOLVED that the Town Council of the Town of Danville hereby requests the Central Contra Costa Sanitary District to reimburse the AB939 fees which would have been collected by the County through the end of the current calendar year; and be it further PAGE i OF RESOLUTION NO. 70-94 RESOLVED that the Central Contra Costa Sanitary District impose solid waste fees sufficient to match the existing AB939 fee of 80¢ per ton on a continual basis and thereby provide ongoing quarterly payment of these collected fees to the Town of Danville.
