HomeMy WebLinkAbout069-94RESOLUTION NO. 69-94 REQUESTING CONTRA COSTA COUNTY TO CEASE ADHERENCE TO TOWN OF DANVILLE RESOLUTION NO. 118-91 AND DISCONTINUE COLLECTION OF THE 80¢ PER TON SURCHARGE AT THE LANDFILL/TRANSFER STATION ON BEHALF OF THE TOWN OF DANVILLE WHEREAS, AB 939 allows local government to set the amount of revenue to be collected to finance solid waste planning and implementation; WHEREAS, as part of the cost mitigation for city staffs in Contra Costa County to respond to the requirements of state-mandated AB 939, the Town Council approved Resolution No. 118-91, requesting Contra Costa County to collect and reimburse to the Town a fee of 80¢ per ton of solid waste as a portion of the "tipping fee"; and WHEREAS, there currently exists a situation whereby some cities in Contra Costa County are receiving AB 939 tipping fee revenues despite not utilizing the Keller Canyon Landfill as anticipated; and WHEREAS, the Public Managers' Association (PMA) Solid Waste Subcommittee has recommended that cities in East and Central County discontinue levying the 80¢ per ton tipping fee through Contra Costa County in order to rectify the incongruence between cities utilizing Keller Canyon and cities receiving tipping fee revenue; and WHEREAS, the PMA Solid Waste Subcommittee further recommended that the cities incorporate the equivalent tipping fee revenue into their solid waste franchise fees; and WHEREAS, the Town of Danville concurs with the recommendation of the PMA Solid Waste Subcommittee; now, therefore be it RESOLVED that the Town Council of the Town of Danville hereby requests Contra Costa County to discontinue collection of the 80¢ per ton surcharge at the landfill/transfer station on behalf of the Town of Danville as part of the disposal fees and be it further PAGE i OF RESOLUTION NO. 69-94 RESOLVED that effective when adopted by the Contra Costa County Board of Supervisors, the disposal fee at Acme shall be reduced by 80e per ton and no further disbursement of the AB 939 fee beyond what has been previously collected this year, shall be made by the County of Contra Costa to cities within the County.
