DESIGNATING AN AREA FOR THE UNDERGROUND INSTALLATION OF
UTILITIES AND ORDERING THE REMOVAL OF ABOVE GROUND UTILITIES IN
AN AREA DESIGNATED AS THE FRONT STREET UNDERGROUND DISTRICT
WHEREAS, tile Town of Danville Town Council has received the recommendation of tile City Engineer
that the area designated in Attachment B, attached hereto and incorporated herein by reference, in
[)allville, California, should be designated as an area in which poles, overhead wires and associated
overhead structures should be removed and that underground wires and facilities for supplying
electric power, comnnufications, or similar or associated service should be illstailed: and
WHEREAS, pursuant to Chapter 18 of the Danville Municipal Code, the City Clerk notified all property
owners as shown on the last equalized assessment roll, and utilities concerned, by mail, of a public
hearing on this matter to be held oll April 5, 1994 at the Town Hall 401 Front Street, Danville,
California, at 7:30 p.m.; and
WHEREAS, a public hearing was held on said date and continued to April 19, 1994, at which time the
Town Council did receive and consider tile recommendation of the City Engineer and did hear any
and all objections or protests which were raised by tile owners of property within the above described
area pertaining to designating this area an underground utility district; now, therefore, be it
RESOLVED, by tile Town Council of the Town of Danville that on behalf of all Danville citizens does
hereby resolve: Section 1. The public necessity, health, safety and welfare require the removal of
poles, overhead wires and associated overhead structures and underground installation of wires and
facilities for supplying electric power, communication, or similar or associated services withilT the areas
as shown in Attachment B, attached hereto, with such area hereby being designated as the Front
Street Underground Utility District. Section 2. I)etermines the undergrounding of utilities as provided
in Section 1 will avoid or eliminate all unusually heavy concentration of overhead distribution facilities.
Section 3. Orders that the removal and underground installation of the above mentioned utilities be
accomplished by December 1, 1994, and that all property owners within said District shall be ready
to receive underground service from such underground system as of October 1, 1994. Sectiou 4.
Directs the City Clerk to mail a copy of this resolution to all affected property owners as such are
shown on the last equalized assessment roll and to the affected utilities. Section 5. This Resolution
shall become effective immediately upon its passage and adoption; now, therefore, be it
FURTHER RESOLVED, that $27,000 is hereby appropriated froill the General Purpose Revenue
sub-account of tile Capital Improvement Fund for the cost of conversion of overhead services to
underground services for affected properties.
