HomeMy WebLinkAbout023-94 RESOLUTION NO. 23-94 SUPPORTING AB 898 PROTECTING CITIES FROM LIABILITY FOR CLEAN UP COSTS FOR SOIL AND WATER CONTAMINATION WHEREAS, the city of Turlock has been named in a cleanup and abatement order for perchloroethylene (PCE) soil and water contamination; and WHEREAS, PCE is a chemical used by dry cleaners and the contamination resulted when PCE leaked from sewer pipes; and '4VHERF. AS, Turlock has maintained that, under existing law, publicly owned treatment works (POTW) are not liable for clean up costs due to contamination put into a system by a third party if the POTW is operating under its permit conditions, and WHERF. AS, this issue has significant implications for public agencies throughout the State including the Town of Danville, and WHEREAS, AB 898, introduced by Assemblymember Costa, will protect ?OTW's from liability for clean up costs when they operate their systems according to permit conditions; now, therefore, be it RESOLVED, that the Town Council of the Town of Danville hereby supports AB 898 and authorizes the Mayor to send letters of support to the appropriate State legislators.
