APPROVING HERITAGE RESOURCE DESIGNATION AND HERITAGE RESOURCE
INCENTIVE PACKAGE FOR THE GEORGE FOSTER HOUSE LOCATED AT 402
HARTZ AVENUE

WHEREAS, Edward and Lillian Noon (Owners/Applicants) are proposing to preserve the
existing one story building located at 4{)2 Hartz Avenue (APN: 208-022-015); and
WHEREAS, the applicant is requesting Heritage Resource Designation and approval of an
incentive package; and
WHEREAS, the Heritage Resource Commission at their public meeting on January 10,
1994, adopted Resolution No. 94-1, recommending the Town Council grant the Heritage
Resource designation and the incentive package requested by the applicants; and
WHERF_AS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the meeting; now, therefore be it
RESOLVED, by the Town Council of the Town of Danville that the Town Council makes
the following findings in support of the Heritage Resource designation:
1. That the George Foster House was constructed in approximately 1926.
2. That the House is representative of the Craftsman architectural style.
3. That the House is representative of the evolution of Danville.
4. That the House is associated with the Foster Family who has made a meaningful
contribution to the community.
5. That the house is a familiar visual feature in downtown Danville.
6. The proposal to convert the structure into a commercial use is consistent with the
General Plan and conforms to the [)owntown Business District Ordinance (Ord.
135).
7. The negligible minor fiscal impact resulting from a reduction of property taxes
collected by the Town is outweighed by the public benefit of preserving the Foster
House; and be it further
RESOLVED, that the Town Council approves the following incentives as a part of the
Heritage Resource incentive package for the property:
1. Expedited processing of permit applications.

Participation in a Mills Act Contract (see Attachment A) with the Town of Danville
fi)r the historic structure. (Note: No reduction of property taxes can be granted
by the Town for the detached second unit on the subject property).

Approval of the request for an exception to the [)owntown Business District
Ordinance (Ordinance No. 135) to allow use of three tandem parking spaces in the
existing driveway°
.
Waiver of parking in-lieu fees for two retail parking spaces in the amount of
$7,000.
Application of the Historic Building Code, where deemed appropriate by the Chief
Building Official, fi)r building modifications necessary for the conversion from
residential to commercial use.

Town provision of an identification plaque designating the structure as a Heritage
Resource (and associated dedication ceremony).

Inclusion of the structure in a Town prepared pamphlet with a history of the
structure, its occupancy and its relationship to Danville's heritage.
BE IT FURTHER RESOLVED, that the Town Council hereby authorizes the Town
Manager to make amendments to the Mills~ Act contract with Edward and Lillian Noon in
the form as lodged with the City Attorney, together with such changes as may hereafter
become necessary, provided such changes do not materially increase the obligations of
the Town thereunder.

February 15, 1994, by the following vote:
