HomeMy WebLinkAbout013-94RESOLUTION NO. 13-94 APPROVING A ONE YEAR TIME EXTENSION OF PRELIMINARY AND FINAL DEVELOPMENT PLAN PUD 90-1 - ALAMO SPRINGS (APN: 197-082-014,-016,-017,-018,-020 AND 197-050-024) WHEREAS, New West Savings and Loan / American Real Estate Group secured approval of Preliminary and Final Development Plan request PUI) 90-1 and Vesting Tentative Map request SD 7453 for 58-unit single family residential development covering a 148_+ acre property located in the northeast quadrant of the Town (Town Council Resolution No. 11- 93 and Ordinance No. 93-1); and WHEREAS, New West Savings and Loan / American Real Estate Group concurrently secured approval from Contra Costa County of Final Development Plan request DP #3003-90 and Vesting Tentative Map request SD 7452 for portion of the 58-unit single family residential development located in the unincorporated community of Alamo; and WHEREAS, the subject site is located at the northern terminus of La Gonda Way, northeast of Interstate 1-680 in the Danville-Alamo area (APN: 197-082-014, -016, -017, - ()18, -020 AND 197-05()-024); and WHEREAS, control of the property was subsequently transferred from New West Savings and Loan / American Real Estate Group to Brazos Asset Management, Inc.; and WHEREAS, the Town of Danville P-l; Planned Unit Development District establishes a 12 month time limit to commence construction after approval of a Final Development Plan; and WHEREAS, the P-1 District allows for up to five extensions of a Final Development Plan permit, each for no more than one year and all extensions totalling five years or less; and WHEREAS, the current property owner has requested a one year time extension of PUD 90-1 by way of a letter dated January 12, 1994, requesting that the permit's expiration date be extended to February 2, 1995; and WHEREAS, the Town Council did review the request for extension at their hearing on February 1, 1994; and PAGE NO. I OF RESOLUTION NO. 13-94 WHERF&S, the public notice of this request was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Town Council approve the request; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Town Council approves a one year time extension of Preliminary and Final Development Plan request 90-1, extending the permit's expiration date to February 2, 19950 APPROVED by the Danville Town Council at a Regular Meeting held on Tuesday, February 1, 1994, by the following w)te: AYES: RITCHEY, NOES: NONE ABSTAINED: NONE ABSENT: NONE GREENBERG, DOYLE, SHIMANSKY, WALDO APPROVED AS TO FORM: ATTEST: C!~ ATTORNEY t~ · * CITY CLERK akgz3 PAGE NO. 2 OF RESOLUTION NO. 13-94
