HomeMy WebLinkAbout009-94 EXHIBIT A RESOLUTION NO. 9-94 APPROVING HERITAGE RESOURCE DESIGNATION AND HERITAGE RESOURCE INCENTIVE PACKAGE (INCLUDING A MILLS ACT CONTRACT) FOR THE PODVA HOUSE LOCATED AT 809 PODVA ROAD (APN: 208-462-013) WHEREAS, Gary Swiggitt (applicant) is proposing to preserve the existing two story building located at 809 Podva Road (APN: 208-462-013) and add a 1,000+ square foot, one story addition to the rear of the existing building; and WHEREAS, the applicant is requesting Heritage Resource Designation and approval of an incentive package (including a Mills Act contract); and WHEREAS, Ordinance No. 89-8 (Historic Preservation) of the Town of Danville establishes standards for review for alterations to designated Heritage Resources; and WHERKAS, the Heritage Resource Commission staff report of December 6, 1993 supported approval of a designation of the building as a Heritage Resource and the requested incentive package; and WHEREAS, the Heritage Resource Commission at their public meeting on December 6, 1993, adopted Resolution No. 93-2, recommending the Town Council approve the proposed project, granting the Heritage Resource designation, approving the Heritage Resource Incentive Package and recommending denial of the proposal to construct the carriage house; and WHEREAS, the Planning Commission held a meeting on December 14, 1993 and recommended that Town Council approve the Development Plan request (DP 93-25) and Sign Modification request (SR 93-23) for the construction of a 1,000+ square foot addition to the existing building and modification of an existing monument sign, and denial of the Variance request (VAR 93-48) to construct a 924± square foot carriage house 5 feet from the side property line where a 15 foot setback is required; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the meeting. NOW, THEREFORE BE IT RESOLVED, by the Town Council makes the following findings in support of the Heritage liesource designation: 1. That the Podva House was constructed in approximately 1884. . That the Podva House is representative of a particular architectural style, namely, Victorian "Stick". 3. That the Podva House is representative of the evolution of Danville. . That the Podva House is associated with the Podva family who has made a meaningful contribution to the community. The Podva House is a familiar visual feature at the intersection of San Ramon Valley Boulevard and Podva Road. . The proposal to continue the administrative office use of the site and Development Plan (DP 93-25) to construct a 1,000+__ square foot addition is consistent with the General Plan and Zoning Ordinance. 7 The negligible minor fiscal impact resulting from a reduction of property taxes collected by the Town is outweighed by the public benefit of preserving the Podva House; and BE IT FURTHER RESOLVED, that the Town Council approves the following incentives as a part of the Heritage Resource Incentive Package for the property: 1. A waiver of all Planning Division fees totaling $850. 2. Expedited processing of permit applications. . Participation in a Mills Act Contract (see Attachment A) with the Town of Danville for the Podva House (no reduction of property taxes can be granted for the addition). . An identification plaque designating the Podva House as a Heritage Resource, and related dedication ceremony. Inclusion in a pamphlet with a description about the history of the structure and its relationship to Danville's heritage; and BE IT FURTHER RESOLVED, that the Town Council hereby authorizes the Town Manager to make amendments to the Mills Act contract with [)avid & Barbara Spurgeon in the form as lodged with the City Attorney, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
