Home My WebLink About123-93RESOLUTION NO. 123-93 AUTHORIZING THE MAYOR TO EXECUTE THE IMPLEMENTATION OF A PARKING PENALTIES SCHEDULE WHEREAS, Assembly Bill 408, passed the legislature and became law on January 1, 1993 decriminalizing parking violations, (they are no longer considered bails or fines but civil penalties); and WHEREAS, AB-408 clearly defines that municipal courts do not have the authority to establish civil penalties for parking violations; and WHEREAS, The present bail schedule established by the Walnut Creek-Danville Municipal Court has no authority as of January 1, 1994; and WHEREAS, AB-408 strongly recommends a uniform schedule for parking violations statewide; and WHEREAS, the Contra Costa Chief's of Police Association, in conjunction with the Administrative Office of the Court, have worked together and agreed on a parking penalty schedule, uniform to the majority of the cities in the County; and WHEREAS, the issuing agency of the parking violations must now set penalties via local ordinance, now, therefore, be it RESOLVED that the Town Council of the Town of Danville does adopt the penalty schedule attached hereto and incorporated herin November 1, 1993.
