HomeMy WebLinkAbout111-93RESOLUTION NO. 111-93 APPROVING A SECOND ONE YEAR TIME EXTENSION OF FINAL DEVELOPMENT PLAN DP 91-7 - THE VILLAGE AT TASSAJARA WHEREAS, Bayside Properties, representing Diablo Ventures West, secured approval of Final Development Plan DP 9l-7 for a 35,682 square foot neighborhood retail center on a 3.15+__ acre site on March 26, 1991 (Planning Commission Resolution No. 91-11); and WHEREAS, the subject site is located on the south side of Camino Tassajara, west of Crow Canyon Road and is known as Parcel A of MS 851-92, further identified as Assessor's Parcel Number 206-010-031; and WHEREAS, the Town of Danville P-l; Planned Unit Development District establishes a 12 month time limit to commence construction after approval of a Final Development Plan; and WHEREAS, the P-1 District allows for up to five extensions of a Final Development Plan permit, each for no more than one year and all extensions totalling five years or less; and WHEREAS, the applicant secured a one year time extension of DP 91-7 on July 7, 1992 from the Town Council, extending the permit's expiration date to May 26, 1993; and WHEREAS, a second request for extension of 1)P 91-7 was been submitted by the applicant on May 25, 1993; and WHEREAS, the Town Council did review the request for extension at their hearing on October 5, 1993; and WHEREAS, the public notice of this request was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Town Council approve the request; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it PAGE 1 OF RESOLUTION NO. 111-93 f RESOLVED, that the Town Council approves a second one year time extension of DP 91- 7, extending the permit's expiration date to May 26, 1994.
