A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
REAFFIRMING THE PREVIOUS ADOPTION OF A NEGATIVE DECLARATION OF
ENVIRONMENTAL SIGNIFICANCE FOR THE 1990 - 1995 HOUSING ELEMENT
UPDATE TO THE DANVILLE 2005 GENERAL PLAN, CERTIFYING THAT THE
UPDATE IS IN SUBSTANTIAL COMPLIANCE WITH STATE HOUSING LAW AND
REFERRING THE UPDATE TO THE STATE OF CALIFORNIA DEPARTMENT OF
HOUSING AND COMMUNITY DEVELOPMENT
WHEREAS, pursuant to Government Code Section 65580 et seq., the Town of Danville
has prepared the 1990 - 1995 Housing Element Update for the Danville 2005 General
Plan; and
WHERF~S, the Danville Planning Commission and Town Council held workshops on
June 5, 1990 and June 12, 1990 respectively to review and comment on the draft program
and policy options for the Housing Element Update; and
WHERF~S, pursuant to Government Code Section 65583(c)(5), the Town held a public
workshop on September 27, 1990 to obtain citizen input regarding the Circulation Draft
of the Housing Element Update; and
WHEREAS, the comments of the public who attended were considered in the preparation
of the Housing Element Update; and
WHEREAS, pursuant to the provisions of State Planning and Zoning Law, it is the function
and duty of the Planning Commission to review and recommend action on proposed
amendments to the Town's General Plan and the individual Elements composing the
General Plan; and
WHEREAS, the Planning Commission did review the Housing Element Update at a series
of public hearings, concluding with a hearing on December 11, 1990; and
WHEREAS, a Negative Declaration of Environmental Significance was prepared for the
Housing Element Update, indicating that no significant impacts are anticipated to be
associated with the implementation of the goals and policies contained in the update; and
WHEREAS, on December 11, 1990 the Planning Commission adopted Resolution No. 90-
57 recommending that the Town Council adopt a Negative Declaration of Environmental
Significance for the Housing Element Update and refer the Element to the State
Department of Housing and Community Development (HCD) for review and comment;
and

WHERFAS, on March 15, 1991 the Town Council, on recommendation of the Planning
Commission, adopted Resolution No. 22-91 adopting a Negative Declaration of
Environmental Significance for the Housing Element Update and referring the Element to
the State Department of HCD for review and comment; and
~rI-IERFa~S, the Element and accompanying documents were sent to HCD in March, 1991;
and
~ZI-IEREAS, the Town Council on May 21, 1991 adopted Resolution No. 98-91
incorporating an Action Plan that prioritized the policies of the Housing Element Update
and established a work program to implement the Element; and
WHERFa~S, HCD's comments on the Housing Element Update were forwarded to the
Town by way of a letter dated May 24, 1991; and
WI-IE~S, the Town has, in the intervening period, taken a variety of actions serving to
implement the goals, policies, and implementation measures outlined in the Housing
Element Update and the accompanying Action Plan; and
WHEREAS, based on thorough consideration of HCD's comments on the Housing
Element Update, revisions, modifications and additions to the Housing Element Update
have been made to fully respond to the comments and to accommodate changes in State
law that deal with the content of Housing Elements since the Element was initially
considered by the Town Council in March, 1991; and
¥~rI-IERFakS, the modifications and additions were considered by the Planning Commission
at a series of public hearings, concluding with a hearing on May 25, 1993; and
WHEREAS, the Planing Commission adopted Resolution No. 93-12 recommending that
the Town Council reaffirm their previous adoption of the Negative Declaration of
Environmental Significance for the Housing Element Update, certify that the update is in
substantial conformance with State housing law, and refer the update to the State of
California Department of Housing and Community Development; and
~rI-IERFA~S, the modifications and additions were considered by the Town Council at a
public hearing on July 6, 1993; and
XVHERFakS, notice of the Town Council hearing was in all respects as required by law;
and
WHEREAS, the Town Council did hear and consider all reports, recommendations and
testimony submitted in writing and presented at the hearing; now, therefore, be it

RESOLVED that the Town Council of the Town of Danville finds that:

The revisions to the Housing Element Update will not have any significant
environmental impacts and is consistent with the information in the Final
Environmental Impact Report prepared for the Danville 2005 General Plan
.
The Negative Declaration of Environmental Significance, which was
previously prepared for the Housing Element Update, remains adequate and
complete as regards the reference revisions.
and, be it further
RESOLVED that the Town Council reaffirms their previous adoption of the Negative
Declaration of Environmental Significance for the Housing Element Update; certifies that
the update is in substantial compliance with State housing law, and refers the Housing
Element Update to the State of California Department of Housing and Community
Development.
APPROVED by the Town Council of the Town of Danville at a Regular Meeting on
July 6, 1993 by the following vote:
