CERTIFYING COMPLIANCE WITH CONTRA COSTA COUNTY'S
MATERIALS DIVERSION ORDINANCE NO. 92-105
WHEREAS, on December 22, 1992 the Contra Costa County Board of Supervisors
adopted Ordinance No. 92-105 the Materials Diversion Ordinance; and
WHEREAS, Ordinance No. 92-105 prohibits landfill operators regulated by Contra Costa
County from accepting solid waste from haulers of local agencies that have not
implemented recycling programs approved and certified by the County Board of
Supervisors; and
WHEREAS, Section 418-10.608 of the Ordinance requires each jurisdiction to submit to
the Board of Supervisors a certified copy of a resolution or other official action of each
City or Town Council by April 1, 1993 outlining and reporting their programs that serve
to meet the requirements of Section 418-10.604; and
WHEREAS, the Central Contra Costa Sanitary District franchises solid waste services on
behalf of the Town of Danville; and
WHEREAS, the Town of Danville has not yet determined whether said Ordinance is lawful
or is an appropriate exercise of the County's authority; however for the time being and
in the interest of comity and goodwill between the Town and County, the Town is
agreeable to providing this Resolution; further provided, however, that by adopting this
Resolution, the Town of Danville is not waiving, nor shall it be deemed to have waived,
any of its rights to contest or challenge the validity, appropriateness or lawfulness of said
Ordinance; now therefore be it
RESOLVED that:

the Central Contra Costa Sanitary District, prior to January 1, 1993, collected at
least seven of the twelve materials identified in Section 418-10.604 through a
weekly curbside recycling program provided to all single family residences within
the Town of Danville. The materials collected through the curbside program are:
aluminum cans, clear and colored glass containers, newsprint, PET bottles, clear
HDPE bottles, colored HDPE bottles, and steel and tin-plated cans.

the Central Contra Costa Sanitary District as of January 1, 1993 arranged with the
City of Walnut Creek to provide all residents of the Town of Danville the
opportunity to recycle additional materials through a drop-off facility operated by
Pacific Rim Recycling located at Lawrence Way in Walnut Creek, In addition to

materials collected at the curb, antifreeze, oil filters, cardboard, white computer
paper, motor oil, automotive batteries, telephone directories, scrap metal,
magazines and mixed paper are accepted.
the Central Contra Costa Sanitary District provided all residents of multi-family
complexes in the Town of Danville the opportunity to recycle aluminum cans, glass
containers, newsprint, PET bottles, clear and colored HDPE, and steel and tin-
plated cans.
the Central Contra Costa Sanitary District provided all businesses in the Town of
Danville the opportunity to recycle aluminum cans, glass containers, newsprint,
PET bottles, clear and colored HDPE, steel and tin-plated cans, cardboard and
mixed paper.
the Central Contra Costa Sanitary District provided free of charge to all residents
of the Town of Danville and non-residents the opportunity to learn home
cornposting of yard waste through workshops that began in January, 1993.
BE IT FURTHER RESOLVED that the Town Council of the Town of Danville certifies that
the recycling programs outlined in this Resolution meet and exceed compliance with
County Ordinance No. 92-105.
APPROVED BY the Danville Town Council at a regular meeting on May 4, 1993 by the
following vote:
