APPROVING AND AUTHORIZING EXECUTION OF CONTRA COSTA CONGESTION
MANAGEMENT AGENCY JOINT POWERS AGREEMENT
WHEREAS, Title 7, Division 1, Chapter 2.6, commencing with Section 65088 of the California
Government Code, requires Contra Costa County to develop, adopt and update periodically
a congestion management program and permits a public agency to be designated as the
county's congestion management agency by resolutions adopted by the county board of
supervisors and the city councils of a majority of the cities representing a majority of the
incorporated area of the county; and
WHEREAS, the Contra Costa Transportation Authority ("Authority") has been so designated
by resolutions adopted by the board of supervisors of the County of Contra Costa and the
city councils of a majority of the cities within the County having a majority of the population
within the incorporated area of the County; and
WHEREAS, pursuant to Measure C, adopted by the Authority and approved by the voters of
Contra Costa County in 1988, the Authority is responsible for administering the growth
management program set forth in Measure C; and
WHEREAS, the incorporated cities within the County and the County believe it to be in the
best interest of the cities and the county to consolidate the designation of the Authority as
congestion management agency with the Measure C growth management program and to set
forth the terms and conditions of such designation, including provision for cost sharing
among the cities and the county for the congestion management functions to be carried out
by the Authority; and
WHEREAS the Authority, the County and the cities within the County have reviewed and
agreed upon the terms and conditions upon which the Authority shall act as designated
congestion management agency, and the manner in which the costs of performance of such
function shall be apportioned among the Authority, the County and the cities within the
county, which terms and conditions are set forth in the Joint Powers Agreement for the
Contra Costa Congestion Management Agency (the "Agreement"), a copy of which is
attached to this resolution and incorporated by reference herein; now, therefore, be it
RESOLVED that the Town Council of the Town of Danville approves the Agreement and the
Council's SWAT representative, Beverly Lane, is hereby authorized to execute the same on
behalf of the Town.

Tuesday, February 2, 1993 by the following vote:
