HomeMy WebLinkAbout152-92 RESOLUTION NO 152-92 APPROVING THE CONTRA COSTA COUNTY MOBILE HOUSEHOLD HA?ARDOUS WASTE COLLECTION PROGRAM WHEREAS, it is illegal and environmentally unsound to dispose of household hazardous wastes in solid waste landfills, stormdrains or sewer systems; and WHEREAS, the California Integrated Waste Management Act of 1989 (AB 939) requires all cities and counties to adopt Household Hazardous Waste (HHW) Elements outlining methods to properly manage, recycle/dispose and reduce household hazardous waste in their jurisdictions; and 4 WHEREAS, all Contra Costa cities and the County have submitted HHW Elements which include mobile collection of HHW; and WHEREAS, the AB 939 Local Task Force for Contra Costa County recommended that the county-wide mobile HHW collection program proposed by the Contra Costa County Health Services Department be implemented in the spring of 1993 to provide residents with an effective collection at the least cost and to meet the requirements of AB 939 with respect to household hazardous waste; and WHEREAS, on April 28, 1992 the County Board of Supervisors approved the program contingent upon receiving approval of the program by a majo~ty of the cites with a majority of the incorporated population; and WHEREAS, the mobile HHW collection program total budget of $1,490,000 will cost individual householders $4.97 per year, and will be paid for through a tipping fee rate of $2.12 per ton (based on $704,967 tons), to be collected beginning July 1, 1993; and WHEREAS, a discounted tipping fee rate during the fiscal year beginning July 1, 1992 to cover start-up program costs of $433,391 will be collected upon receiving the required city approval; and WHE~, Contra Costa County will be responsible for being the generator for hazardous materials manifest purposes and will assume operational and generator liability for the program; and WHEREAS, the County Health Services Deparunent will establish a HHW Oversight Committee, that will include four city mangers and three city project managers to be appointed by the Public Managers Association, to review program budget and assist in site selection, program publicity and ongoing planning and monitoring; and RESOLUTION NO. 152-92 PAGE 1 OF 2 WHEREAS, the County Health Services Department will provide the Oversight Committee and each city quarterly and annual reports on the number of participants, expenditures, wastestream types and quantifies collected and disposal and recycling methods used and will also provide an annual report to the Local Task Force; and WHEREAS, the County will maintain a separate accounting for fees collected and expenditures made to implement the HHW program; and WHEREAS, any region of the County (west, central or east), upon obtaining the approval of a majority of the cities in that region, may elect to withdraw from the Health Services Department mobile program after providing the County written notice of such withdrawal 120 days before the effective date; now therefore be it RESOLVED, by the Danville Town Council does hereby approve the Contra Costa County Mobile Household Hazardous Waste Collection Program and its funding through the collection of solid waste tipping fees, ADOPTED by the Danville Town Council at its regular meeting on October 6, 1992, by the following vote: AYES LANE, NOES NONE ABSENT NONE ABSTAIN NONE SHIMANSKY, DOYLE, GREENBERG, RITCHEY APPROVED AS TO FORM: ATTEST: CITY ATTORNEY w CITY CLERK RESOLUTION NO. 152-92 PAGE 2 OF 2
