HomeMy WebLinkAbout127-92RESOLUTION NO. 127-92 AUTHORIZING TOWN MANAGER TO ENTER INTO A LEGAL SERVICES AGREEMENT WITH THE LAW FIRM OF SHUTE, MIHALY & WEINBERGER - DOUGHTERY VALLEY DRAFT ENVIRONMENTAL IMPACT REPORT WHEREAS, Shapell Industries and Windemere Properties are the owners of virtually all of the real property comprising the so-called Doughtery Valley, located in the unincorporated portion of Contra Costa County generally sought of the Town of Danville; and WHERF~S, Shapell and Windemere have applied to Contra Costa County for certain development entitlements in the Doughtery Valley; and WHEREAS, in response to such applications Contra Costa County has prepared a proposed Doughtery Valley Specific Plan, providing for the construction of up to 11,000 new homes, 700,000 square feet of commercial uses and the addition of up to 29,000 new residents to the Doughtery Valley; and WHEREAS, in conjunction with such proposed Specific Plan the County has issued a Draft Environmental Impact Report which purports to address the adverse environmental impacts which will result from development on such a massive scale; and WHEREAS, the Town of Danville desires to obtain professional legal advice, consultation and other services in connection with its review of such proposed Specific Plan and Draft Environmental Impact Report; and WHEREAS, the law firm of Shute, Mihaly & Weinberger is qualified to and has agreed to provide such services pursuant to a legal services agreement; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville that the Town Manager be, and hereby is, authorized to execute, on behalf of the Town, a legal services agreement with the law firm of Shute, Mihaly & Weinberger, in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided that such changes do not materially increase the obligations of the Town thereunder; and be it PAGE I OF RESOLUTION NO. 127-92 FURTHER RESOLVED, that the sum of $15,000.00 is hereby appropriated to fund payments under such agreement.
