HomeMy WebLinkAbout104-92RESOLUTION NO. 104-92 A RESOLUTION OF THE DANVILLE TOWN COUNCIL APPROVING A ONE YEAR TIME EXTENSION OF FINAL DEVELOPMENT PLAN DP 91-7 - THE VILLAGE AT TASSAJARA WHEREAS, Bayside Properties, representing Diablo Ventures West, secured approval of Final Development Plan DP 91-7 for a 35,682 square foot neighborhood retail center on a 3.15& acre site on March 26, 1991 (Planning Commission Resolution No. 91-11); and WHEREAS, the subject site is located on the south side of Camino Tassajara, west of Crow Canyon Road and is known as Parcel C of MS 856-88, further identified as Assessor's Parcel Number 206-010-031; and WHEREAS, the Town of Danville P-l; Planned Unit Development District establishes a 12 month time limit to commence construction after approval of a Final Development Plan; and WHEREAS, The P-1 District allows for up to five extensions of a Final Development Plan permit, each for no more than one year and all extensions totalling five years or less; and WHEREAS, a request for extension of DP 91-7 has been submitted by the applicant; and WHEREAS, the Town Council did review the request for extension at their hearing on July 7, 1992; and WHERF~S, the public notice of this request was given in all respects as required by law; and WHEREAS, a staff report was submitted recommending that Town Council approve the request; and WHEREAS, with the Final Development Plan approval for McDonald's (DP 92-2), Condition Of Approval #F.8. of DP 91-7 needs to be modified to read as follows: F.8. (revised) The center shall contain 171 parking spaces as depicted on the project drawings cited in Condition A. 1.a. Based on a numerical calculation of one space per 250 square feet of gross floor area and McDonald's Restaurant use of six shopping center spaces in perpetuity, this site exceeds the minimum allowable by 22 spaces. This entitlement further grants a numerical parking variance up to 10 PAGE 1 OF RESOLUTION NO. 104-92 percent or 17 spaces to allow additional restaurant capacity in the shopping center. WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED, that the Town Council approves a one year extension of DP 91-7, extending the permit's expiration date to May 26, 1993, and, be it further RESOLVED, that the Town Council modifies Condition Of Approval #F.8. to read as recommended by staff and as indicated above in this resolution.
