APPROVING A RESOLUTION OF INTENT TO REIMBURSE
GENERAL FUND EXPENDITURES INCURRED SUBSEQUENT TO
MAY 19, 1992 RELATED TO COMPLIANCE WITH THE
FEDERAL CLEAN WATER ACT OF 1987
WHERF~S, the Town Council of the Town of Danville recognizes its responsibility for
complying with the Federally mandated Clean Water Act of 1987; and
WHEREAS, the San Francisco Bay Regional Water Quality Control Board has
determined that the Town of Danville is responsible for complying with the Federal
Clean Water Act of 1987 and has determined that the Town's General Fund
expenditures are not an appropriate funding source for compliance with the Federal
Clean Water Act of 1987; and
WHEREAS, to date, the implementation of a dedicated funding source to provide for
compliance with the Federal Clean Water Act of 1987 has not been accomplished; and
WHEREAS, the Town Council of the Town of Danville deems it appropriate to recover
costs associated with the establishment of a Stormwater Pollution Control Program and
compliance with the Federal Clean Water Act of 1987; now, therefore, be it
RESOLVED, that the Town Council of the Town of Danville does hereby adopt this
Resolution of Intent to reimburse the General Fund expenditures incurred subsequent
to June 2, 1992 related to complying with the Federal Clean Water Act of 1987 through
participation in a County Stormwater Benefit Assessment program or any other program
so adopted to establish a dedicated funding source; and, be it
FURTHER RESOLVED, that this Resolution of Intent is hereby approved and the Town
staff is hereby authorized and directed to implement measures necessary to execute this
intent on behalf of the Town.
APPROVED by the Danville Town Council at a Regular Meeting on June 2, 1992 by the
following vote:
