HomeMy WebLinkAbout088-92RESOLUTION NO. 88-92 SUPPORTING ASSEMBLY BILL NO. 2768 (CAMPBELL) TO AMEND THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT ACT TO PROVIDE FUNDING FOR THE CONTRA COSTA CITIES · COUNTY · DISTRICT STORMWATER POLLUTION CONTROL PROGRAM WHEREAS, on November 16, 1990, the Federal Environmental Protection Agency adopted the National Pollutant Discharge Elimination System Permit (NPDES) Application Regulations for Stormwater Discharges, as required by the Federal Clean Water Act; and WHEREAS, said regulations require a submittal of permit applications and the implementation of programs to minimize or eliminate pollutants from stormwaters entering San Francisco Bay; and WHEREAS, the State of California San Francisco Bay Regional Water Quality Control Board has requested Contra Costa County, its incorporated cities, and the Contra Costa County Flood Control and Water Conservation District be covered by one comprehensive permit; and WHEREAS, the Executive Officer of the San Francisco Bay Regional Water Quality Control Board determined on April 12, 1991 all municipal entities within Contra Costa County having stormwater systems interconnected with or within the same watershed as a system designated within the NPDES regulations, and finding stormwater discharges contributed to violations of water quality standards and were significant contributors to pollutants to the receiving waters of the Bay-Delta System; and WHEREAS, the San Francisco Bay Regional Water Quality Control Board has indicated that financing the Stormwater Pollution Control Program needs an independent, dedicated source of funding other than General Fund revenues; and WHEREAS, financing alternatives are extremely limited to municipalities to finance the Stormwater Pollution Control Program; and WHEREAS, the success of obtaining the NPDES Areawide Municipal Permit requires the establishment of independent financing for the Program; and WHERF~S, the Cities ~ County ~ District Stormwater Pollution Control Program has requested specific State legislation to enable the Contra Costa County Flood Control and Water Conservation District to establish and collect a Stormwater Utility Benefit Assessment Fee on behalf of participating municipalities; and WHEREAS, the fee would need annual approval by a majority of the governing body of the municipality in order for the fee to be collected; and PAGE 1 OF RESOLUTION NO. 88-92 WHEREAS, the Contra Costa County Flood Control and Water Conservation District could not arbitrarily impose such a fee without approval by each municipality; and WHEREAS, the fee collected by Contra Costa County, minus a small administrative charge, shall be transmitted to Danville for use in managing the NPDES program; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville, that the Town of Danville does hereby support Assembly Bill 2768 (Campbell), which would permit the Contra Costa County Flood Control and Water Conservation District the ability to establish a Stormwater Utility Benefit Assessment Fee as a financing option to municipalities located within Contra Costa County to fund the development and implementation of the Stormwater Pollution Control Program.
