HomeMy WebLinkAbout064-92RESOLUTION NO. 64-92 APPROVING AN AFFORDABLE HOUSING RENTAL AGREEMENT BETWEEN LAUREL COTTAGE PARTNERS AND THE TOWN OF DANVILLE REGULATING OCCUPANCY OF ONE RENTAL UNIT IN PUD 91-11 AND SD 7020 WHEREAS, on January 27, 1992 Town Council approved Laurel Cottage Partners' application PUD 91-11 and SD 7020 for a five lot - six unit high density project on .5 +/- acre site located at 60 Laurel Drive (APN: 216-010-006); and WHEREAS, condition of approval for the project required the applicants to provide one very low income unit within the development; and WHEREAS, Laurel Cottage Partners is required to execute an affordable housing rental agreement with the Town of Danville regulating the occupancy of one rental unit in the development prior to approval of the Final Map for the project; and WHEREAS, promoting the development of affordable housing within the Town of Danville is a goal of the Draft Housing Element of the Town of Danville; and WHEREAS, the project is located within a Redevelopment Area where State law mandates that multiple family projects include affordable housing; and WHEREAS, the Town Council reviewed the subject agreement on May 19, 1992; and WHE~, a staff report was submitted recommending the Town Council approve the Agreement with Laurel Cottage Partners for one rental unit; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby finds that the agreement regulating the occupancy and rental of one unit in PUD 91-11 and SD 7020 is appropriate; and be it further RESOLVED, the Town Council hereby authorizes the Town Manager to execute the affordable housing rental agreement with Laurel Cottage Partners in the form as lodged with the City Attorney, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
