HomeMy WebLinkAbout058-92RESOLUTION NO. 58-92 DESIGNATION OF THE CONTRA COSTA TRANSPORTATION AUTHORITY AS PROGRAM MANAGER FOR IMPLEMENTATION OF ASSEMBLY BILL 434 - THE VEHICLE REGISTRATION FEE PROGRAM FOR CLFAN AIR IN THE BAY AREA FOR THE TOWN OF DANVILLE WHEREAS, Assembly Bill (AB) 434, the Vehicle Registration Fee Program for Clean Air in the Bay Area, by Byron Sher, has been passed and signed into law by the Governor of the State of California; and WHEREAS, AB 434 authorizes the imposition by the Bay Area Air Quality Management District (Air District) of a vehicle registration fee for the purpose of reducing air pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies; and WHEREAS, forty percent of the revenues generated within each county, based upon the county's share of fee-paid vehicle registration, are available for allocation within the county by the Air District or a designated program manager for each county; and WHE~S, designation of an overall program manager requires adoption of designating resolutions by the county Board of Supervisors and the city councils of a majority of the cities representing the majority of the population in the incorporated area of the county; and WHEREAS, the Contra Costa Transportation Authority can effectively incorporate serving as AB 434 program manager with management of its "carpool, van pool, and park and ride 1oI? funds (also known as Transportation Demand Management or TDM funds), to the benefit of TDM programs in Contra Costa County; now therefore be it RESOLVED, that the Town of Danville does hereby designate the Contra Costa Transportation Authority as the overall program manager for AB 434 Vehicle Registration fees in Contra Costa County, and be it FURTHER RESOLVED, that the following terms and conditions shall apply to allocation of the AB 434 funds: . The Authority shall develop a process for selection of projects and programs for application of the AB 434 funds that improve air quality. In selecting projects and programs, and to the extent consistent with Air District administrative regulations, the CCTA will promote equitable distribution among the four sub-regions of the county, considering the population, vehicle registration and employment base in each sub-region. PAGE I OF RESOLUTION NO. 58-92 . , Funds shall be used for projects that reduce air pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies. Funding should emphasize new programs and projects, the marginal cost of expanding an existing program or project, or consolidation and enhancement of programs associated with implementing the District's Trip Reduction Ordinance, including funding for such programs on an on-going basis. . Each local jurisdiction or agency receiving AB 434 funds shall provide, upon the request of the Air District, an audit of the projects and programs for which such funds are expended, with the auditor chosen by the Air District and paid for by the local agency using AB 434 or local funds. . To the extent determined to be appropriate, CCTA shall integrate the allocation of AB 434 funds with the allocation process for its TDM funds, and shall emphasize a cooperative county-wide process for the programs. , Up to five (5) percent of the funds available may be used by CCTA to administer this program, subject to allowance by the Air District of such charges.
