APPROVING THE AWARD OF CONTRACT FOR THE DIABLO ROAD IMPROVEMENTS,
CAMINO TASSAJARA TO EL CERRO BOULEVARD, CONTRACT NO. 91-11C
WHEREAS, the Town Council has previously approved bidding the Diablo Road Improvements, Camino
Tassajara to El Cerro Boulevard (Contract No. 91-11C); and
WHEREAS, $793,599 was originally appropriated for the project of which $155,000 has been spent,
leaving an available balance of $638,599; and
WHEREAS, the City Clerk of this Town did, in open session on the 27th day of February 1992, publicly
open and read aloud the sealed bids received as required by law; and
WHEREAS, the low bidder is Les McDonald of Hayward, CA, and the City Engineer has recommended
awarding a contract for the project to said firm; and
WHERF~S, the total cost is $729,807, $91,208 less than appropriated; now, therefore, be it
RESOLVED, by the Town Council of the Town of Danville, that the Town Manager be, and hereby is
authorized to execute, on behalf of the Town, a written contract with Les McDonald Construction in the
amount of $475,615, plus a 15% Construction Contingency of $71,342, plus additional costs of $182,850
for pole relocation, right-of-way acquisition, tree mitigation, testing, and construction survey staking;
including a 15%+ contingency for a total of $729,807, for work in connection with Diablo Road
Improvements, Camino Tassajara to E1 Cerro Boulevard in the form as lodged with the City Clerk,
together with such changes as may hereafter become necessary, provided such changes do not materially
increase the obligations of the Town thereunder, and to receive and approve all bonds in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the
Town; and, be it
FURTHER RESOLVED, that $91,208 be appropriated from the NERIAD Contingency account to cover
the difference between the total construction costs of $729,807 and the amount remaining from the
original budget of $638,599; and, be it
FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this Resolution,
transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division
of Apprenticeship Standards, P.O. Box 603, San Francisco, CA 94101. Should a finding of any
discrepancy regarding the ratio of apprentices to journeymen be made, the Town shall notify the Division
of Apprenticeship Standards of such findings.
