A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY
AND THE CONCURRENT SUBMITTAL AND CONSIDERATION OF A PRELIMINARY
DEVELOPMENT PLAN - REZONING REQUEST FOR A 7 +/- ACRE SITE
IDENTIFIED AS ASSESSORS PARCEL NUMBER 202-171-018 (FREEMAN)
WHEREAS, E.J. Freeman (Owner and Applicant) has submitted a request for authorization
of a General Plan Amendment Study and concurrent Preliminary Development Plan -
Rezoning for approximately 7 +/- acres located at the terminus of Gwen Court, further
identified as Assessors Parcel Number 202-171-018; and
WHEREAS, the subject is identified in the Danville 2005 General Plan for General Open
Space restricting development; and
WHEREAS, the property owner has requested that the Town of Danville consider a
General Plan Amendment to accommodate a residential development with up to five lots;
and
WHEREAS, The Town of Danville requires Town Council authorization prior to
preparation of General Plan Amendment Studies; and
WHEREAS, the Town Council did consider the project proponent's request at a hearing
on February 4, 1992; and
WHEREAS, a staff report was submitted recommending that the Town Council take the
following actions;

Authorize the initiation of a General Plan Amendment (GPA) Study covering
the 7 +/- acre Freeman property.

Direct the project proponents to concurrently submit a Preliminary
Development Plan - Rezoning application, which shall include a site plan
and detailed preliminary grading plan demonstrating the proposal's
compliance with the intent and requirements of the Town's Scenic Hillside
and Major Ridgeline Development Ordinance. Additionally, direct the
project proponents to submit plans depicting the grading required to access
each proposed building site.

Direct the project proponents to submit all required information to
complete the required environmental review of this proposal. Information
submitted should include a soil and geotechnical report, a tree survey of
protected trees subject to development impacts and any additional
information deemed necessary by Town staff upon completion of an Initial
Study for the proposal.

Direct the project proponents to submit written architectural design
guidelines and conceptual exterior elevations for this proposed hillside
development.

WHEREAS, the Town Council did hear and consider all reports, recommendations, and
testimony submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Town Council of the Town of Danville concurs with the
recommendations of staff and authorizes the preparation of a General Plan Amendment
Study with a concurrent Preliminary Development Plan - Rezoning application, as cited
above, and as outlined in additional detail in the staff report prepared for this item dated
February 4, 1992.
RESOLVED that, in authorizing the above mentioned General Plan Amendment Study, the
Town Council is not indicating any predisposition to approve the requested General Plan
Amendment.
APPROVED by the Danville Town Council at a Regular Meeting held on February 4, 1992
by the following vote:
