AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY AND THE
CONCURRENT SUBMITTAL AND CONSIDERATION OF A PRELIMINARY DEVELOPMENT
PLAN - REZONING REQUEST FOR A 371+/- ACRE SITE IDENTIFIED AS ASSESSORS
PARCEL NUMBERS 202-050-041, 042, 047, 049 AND 215-040-007 (MAGEE/OWNER)
WHEREAS, Bryan and Murphy (Applicant), representing Jerome Magee (Owner), has submitted a
request for authorization of a General Plan Amendment Study and a concurrent Preliminary
Development Plan - Rezoning application for a 371+/- acre site located south of Diablo Road and
northeast of McCauley Road (further identified as Assessors Parcel Numbers 202-050-041,042, 047, 049
AND 215-040-007); and
WHEREAS, the subject site is identified in the Danville 2005 General Plan for Residential Single Family -
Low Density (1-3 units/acre), Rural Residential (five acre minimum) and Open Space/Agricultural land
uses; and
WHEREAS, the property owner has requested that the Town of Danville consider a General Plan
Amendment to accommodate a residential development with 300+/- units; and
WHEREAS, The Town of Danville requires Town Council authorization prior to preparation of General
Plan Amendment Studies; and
WHEREAS, the Town Council did consider the request at the hearing of January 21, 1992; and
WHERF~S, a staff report was submitted recommending that the Town Council take the following actions
1. Authorize the initiation of a General Plan Amendment (GPA) Study.

Direct the project proponents to concurrently submit a Preliminary Development Plan -
Rezoning application, which shall include a site plan and detailed preliminary grading plan
demonstrating the proposal's compliance with the intent and requirements of the Town's
Scenic Hillside and Major Ridgeline Development Ordinance. Additionally, direct the
applicant to fund preparation of a alternate site plan which shall be analyzed as a project
alternative in the Environmental Impact Report (EIR).

Direct the project proponents to submit all required information to complete the
environmental review of this proposal. Information submitted should include a soil and
geotechnical report, a tree survey of protected trees subject to development impacts and
any additional information deemed necessary by Town staff upon completion of an Initial
Study for the proposal.

Direct the project proponents to submit supplemental written material to verify that a
notice of non renewal of the Williamson Act contract has been filed as required by Policy
1.17 of the Danville 2005 General Plan.

XVHEREAS, the Town Council d~ hear and consider all reports, rec _nmendations, and testimony
submitted in writing and presented at the hearing; now, therefore, be it
RESOLVED that the Town Council of the Town of Danville concurs with the recommendations of staff
and authorizes the preparation of a General Plan Amendment Study with a concurrent Preliminary
Development Plan - Rezoning application, as cited above, and as outlined in additional detail in the staff
report prepared for this item dated January 21, 1992, and be it further
RESOLVED that, in authorizing the above mentioned General Plan Amendment Study, the Town Council
is not indicating any predisposition to approve the requested General Plan Amendment.
