APPROVING THE WAIVER OF CERTAIN DEVELOPMENT FEES FOR
FOURTEEN MODERATE INCOME HOUSING UNITS TO BE CONSTRUCTED
WITHIN PUD 90-7/SD 7604 (BAS HOMES)
WHEREAS, on December 4, 1990, Danville the Town Council adopted Ordinance No. 90-
23 granting PUD 90-7 and SD 7604 to Bas Homes for construction of not more than 73
units on a 16.2 +/- acre parcel located on the south side of Camino Tassajara, west of
Rassani Drive (APN # 206-020-057); and
WHEREAS, conditions of approval required that Bas Homes construct a minimum of
fourteen "moderate" income units within the development; and
WHERFakS, Bas Homes has requested that the Town Council waive development
processing fees (Parkland Dedication in lieu, Building Permit, Residential TIP, Engineering
Map Check, Child Care) for the fourteen "moderate" income units in the development;
and
WHEREAS, conditions of approval for the project requires the Town Council to take
separate action to waive fees prior to approval of the final map; and
WHEREAS, action by the Town Council to waive fees in order to encourage the provision
of affordable housing is consistent with the goals and policies of the Draft Housing
Element for the Town of Danville; and
WHEREAS, the total amount of fees requested to be waived by the Town for the fourteen
"moderate" income units is $85,694; now therefore, be it
RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby
finds that waiving development processing fees in order to encourage construction of
affordable housing in the Town of Danville is appropriate; and be it further

RESOLVED, that the Town Council hereby approves the waiver of $85,694 in
development processing fees for the fourteen "moderate" income units in the Bas at
Tassajara development (PUD 90-7/SD 7604).
APPROVED by the Danville Town Council at a Regular Meeting held on December 17,
1991, by the following vote:
