APPROVING A MODERATE INCOME HOUSING AGREEMENT
BETWEEN BAS HOMES AND THE TOWN OF DANVILLE
REGULATING OCCUPANCY, SALE AND RESALE OF THE FOURTEEN
MODERATE INCOME UNITS WITHIN PUD 90-7/SD 7604 (BAS HOMES).
WHERF~S, on December 4, 1990 the Danville Town Council adopted Ordinance No. 90-
23 granting PUD 90-7 and SD 7604 (Bas Homes) for construction of not more than 73
units on a 16.2 +/- acre parcel located on the south side of Camino Tassajara, west of
Rassani Drive (APN # 206-020-057); and
WHEREAS, conditions of approval required that Bas Homes construct a minimum of
fourteen "moderate" income units within the development; and
WHEREAS, Bas Homes is required to execute a Moderate Income Housing Agreement
("Agreement") with the Town of Danville regulating the occupancy, sale and resale of the
fourteen "moderate "income units; and
WHEREAS, promoting the development of affordable housing within the Town of Danville
is a goal of the Draft Housing Element of the Town of Danville; and
WHEREAS, the Town Council reviewed the Agreement with Bas Homes for regulating
occupancy, sale and resale restrictions of the fourteen "moderate" income units on
December 17, 1991; and
WHEREAS, a staff report was submitted recommending that the Town Council approve
the Agreement with Bas Homes for the fourteen "moderate" income units; now therefore
be it
RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby
finds that the Agreement regulating the occupancy, sale and resale for the "moderate"
income units within PUD 90-7/SD 7604 is appropriate; and be it further

RESOLVED, that the Town Council hereby authorizes the Town Manager to execute the
Moderate Income Housing Agreement with Bas Homes in the form as lodged with the City
Attorney, together with such changes as may hereafter become necessary, provided such
changes do not materially increase the obligations of the Town thereunder.
