TO EXTEND THE DATE FOR SUBMISSION
OF THE ADOPTED SOURCE REDUCTION AND RECYCLING (SRR)
AND HOUSEHOLD HAZARDOUS WASTE (HHW) ELEMENTS
TO THE COUNTY TO MAY 1, 1992
WHEREAS, as initially enacted, the California Integrated Waste Management Act of 1989
(AB 939) (PRC Section 40,000, et seq.) required each city and county to prepare and
adopt, on or before July 1, 1991, a Source Reduction and Recycling Element (SRRE); and
WHEREAS, AB 2707 amended AB 939 and required each city and county to prepare and
adopt a separate Household Hazardous Waste Element (HHWE) that was previously a
component of the SRRE; and
WHEREAS, AB 1820 further amended AB 939 and provides an extension to December
1991, for those cities that have determined a need for preparation and certification of an
Environmental Impact Report pursuant to CEQA for the SRRE and HHWE; and
WHEREAS, the Town Council of the Town of Danville designated Central Contra Costa
Sanitary District (Central San) as the agency responsible for preparing the SRRE and
HHWE; and
WHEREAS, Central San is preparing a joint Environmental Impact Report with San Ramon
and Walnut Creek on behalf of the Town, with Central San as the lead agency; and
WHEREAS, AB 2092 has been introduced in the legislature to extend the deadline for
adopting the SRRE and HHWE for those cities that have determined a need for
preparation and certification of an Environmental Impact Report to May 1, 1992; and
WHEREAS, the Town and Central San were advised that AB 2092 would be enacted in
1991, however it was made a two-year bill and will , if enacted, not become law until at
least January, 1992; and
WHEREAS, the California Integrated Waste Management Board (CIWMB) has stated that,
"At this time, the Board will not initiate enforcement actions against cries who failed to
meet the July 1, 1991, County submission deadline."; and
WHEREAS, Contra Costa County staff advised all jurisdictions to remain on the schedule
proposed in All 2092 in order for the County to meet the July 1, 1992 submittal of the
County Integrated Waste Management Plan, as proposed in AB 2092; and

WHEREAS, Central San has prepared a Preliminary Draft SRRE and HHWE on behalf of
the Town and submitted the draft plans to the Town, County, the AB 393 Local Task
Force, CIWMB, ABAG and neighboring jurisdictions for public review; and
WHEREAS, preparation of the joint Environmental Impact Report associated with the
adoption of the SRRE and HHWE will not be complete on or before January 1, 1992,
because the present time lines do not allow for the required review periods according to
the California Environmental Quality Act; now therefore be it
RESOLVED by the Town Council of the Town of Danville as follows:

Central San, with the assistance of the Town, will move forward with all due speed
to complete the preparation and adoption of the SRRE and HHWE and to prepare
and certify an Environmental Impact Report regarding the same.

The Town of Danville has submitted its draft SRRE and HHWE to the County, and
will submit a copy of this adopted resolution to the County on or before January
2, 1992, as stated in proposed language in AB 2092 and as requested by County
staff.
o
The Town anticipates that it will submit its final adopted SRRE and HHWE to the
County upon completion and certification of the Environmental Impact Report or
on May 1, 1992, whichever occurs earlier, in compliance with the proposed
language in AB 2092 for entities preparing an Environmental Impact Report.
