HomeMy WebLinkAbout216-91RESOLUTION NO. 216-91 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY AND THE CONCURRENT SUBMITTAL AND CONSIDERATION OF A PRELIMINARY DEVELOPMENT PLAN - REZONING FORAN 8.7 +/- ACRE SITE IDENTIFIED AS ASSESSORS PARCEL NUMBERS 208-170- 013, 015 AND PARCEL C OF SD 6098 (TOgVERY) WHEREAS, Ron Towery (Owner) has submitted a request for authorization of a General Plan Amendment Study and concurrent Preliminary Development Plan - Rezoning for approximately 8.7 +/- acres adjacent to and south of 355 Cliffside Drive (further identified as Assessors Parcel Number 208-170-013,015 and Parcel C of SD 6098); and WHEREAS, the subject is identified in the Danville 2005 General Plan for Rural Residential development, requiring developed parcels to be a minimum of five acres in size; and WHEREAS, the property owner has requested that the Town of Danville consider a General Plan Amendment to accommodate a residential development with up to five units; and WHEREAS, The Town of Danville requires Town Council authorization prior to preparation of General Plan Amendment Studies; and WHEREAS, the Town Council did consider the project proponent's request at the hearing of November 19, 1991; and WHEREAS, a staff report was submitted recommending that the Town Council take the following actions; . Authorize the initiation of a General Plan Amendment (GPA) Study covering the 7.8 +/- acre Towery property located adjacent to and south of 355 Cliffside Drive, further identified as Assessors' Parcel Number 208-170-013 and 015 and Parcel C (.8 acres) of SD 6098. e Direct the project proponents to concurrently submit a Preliminary Development Plan - Re. zoning application, which shall include a site plan and detailed preliminary grading plan demonstrating the proposal's compliance with the intent and requirements of the Town's Scenic Hillside and Major Ridgeline Development Ordinance. Additionally, direct the project proponents to submit plans depicting the grading required to access the proposed building sites. PAGE 1 OF RESOLUTION 216-91 . Direct the project proponents to submit all required information to complete the required environmental review of this proposal. Information submitted should include a soil and geotechnical report, a tree survey of protected trees subject to development impacts and any additional information deemed necessary by Town staff upon completion of an Initial Study for the proposal. , Direct the project proponents to guidelines and conceptual exterior development. submit written architectural design elevations for this proposed hillside . Direct the project proponents to submit supplemental written background material to assist Town staff in determining the legal status of Parcel C of SD 6098. WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; now, therefore, be it RESOLVED that the Town Council of the Town of Danville concurs with the recommendations of staff and authorizes the preparation of a General Plan Amendment Study with a concurrent Preliminary Development Plan - Rezoning application, as cited above, and as outlined in additional detail in the staff report prepared for this item dated November 19, 1991. RESOLVED that, in authorizing the above mentioned General Plan Amendment Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
