ACCEPTING THE GREENBROOK SCHOOL PARK,
PHASE I-B IMPROVEMENTS, CONTRACT NO. 90-08
WHEREAS, on March 19, 1991, the Town Council of the Town of Danville, by Resolution
No. 59-91 awarded Contract No. 90-08 for the purpose of completing the Greenbrook
School Park Phase I-B Improvements; and
WHEREAS, the City Engineer has determined that the work under this project has been
completed as of October 11, 1991, in compliance with the plans and specifications
thereof; now, therefore, be it
RESOLVED, by the Town Council of the Town of Danville that said work by and with
CAG~ & DORWARD LANDSCAPE CONTRACTORS, is hereby accepted as complete; and
be it
FURTHER RESOLVED, that the City Clerk of the Town of Danville is hereby authorized
and directed to file with the County Recorder of the County of Contra Costa, a Notice of
Completion of said project within ten (10) days from the date hereof.

Award of Contract No. 90-08 Greenbrook School Park, Phase I-B
Improvements
This report recommends that Town Council adopt Resolution No. 59-91 approving the
award of Contract 90-08, Greenbrook School Park, Phase IoB Improvements, for the low
bid amount of $98,461.20 and appropriating $6,946.00 from the Park Fund.
BACKGROUND
Resolution No. 14-91 approving the Calling for Bids for Greenbrook School Park, Phase
I-B Improvements Contract No. 90-08 was approved by the Town Council on January 15,
1991. Bids were opened on March 8, 1991, and a total of twelve (12) bids were received.
Attached is a copy of the bid results. 'Staff has reviewed the bids and concludes that they
are good bids. Cagwin & Dotward was the low bidder at $98,461.20.
DROUGHT RESTRICTIONS
Due to anticipated drought restrictions, we may wish to delay seeding the turf and
planting trees, shrubs and ground cover. These items were bid as Additive Alternates to
provide the ability to accept or delete these items at a predetermined price depending on
drought restriction decisions. The low bidder's cost for seeding and planting is
$24,628.00.
These funds, along with an appropriate contingency, will be set aside should the planting
and seeding work not be completed within this contract. This will allow us to finish the
project once the drought resfrictions are lifted.

RECOMMENDED ACTION
It is recommended that the Town Council approve Resolution No. 59-91 awarding
Contract No. 90-08 for the Greenbrook School Park, Phase I-B Improvements with Cagwin
& Dorward and to appropriate $6,946.00 from the Park Fund unappropriated balance to
provide for a 10% construction contingency.

RESOLUTION NO. 59-91
A RESOIMTION OF AWARD'OF CONTRACT FOR GREENBROOK SCHOOL PARK,
PItASE I-B IMPROVEMENTS
WHEREAS, the Town Council has previously approved funding for the design and
construction of the Greenbrook School Park; and
WttERFfftS, the City Clerk of this Town did, in open session on the 8th day of March 1991
publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, Cagwin & Dorward was the low bidder at 98,461.20, and
WItEREAS, the Town Council has appropriated $321,539.O0 and the total project cost is
anticipated to be $328,485.00; and
WtlEREAS, in order to proceed with the project, additional funds need to be appropriated;
now, therefore, be it
RESOLVED, by file Town Council of the Town of Danville that the Town Manager be, and
hereby is, authorized to execute on behalf of the Town, the Contract for Greenbrook
School Park, Phase I-B Improvements. with Cagwin & Dotward, in the form as lodged with
the City Clerk, together with such changes as may hereafter become necessary, provided
such changes do not materially increase the obligations of the Town thereunder; and be
it
FURTIlER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this
Resolution, transmit an Extract of Public Works contract award to the Departlnent of
Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco,
California, 94101. Should a finding of any discrepancy regarding tile ratio of apprentices
to journeymen be made, the Town shall notify the Division of Apprenticeship Standards
of such findings; and be it
FURTHER RESOLVED, by the Town Council of the Town of Danville that the Town
Council hereby appropriates $6,946.00 from the Park Fund unappropriated balance for
development of the Greenbrook School Park, Phase I~B Improvements.
